FORT EDWARD, N.Y. (AP) — A man was convicted of second-degree murder Tuesday for fatally shooting a young woman when the SUV she was riding in mistakenly drove up his rural driveway in upstate New York.

A jury found Kevin Monahan, 66, guilty of second-degree murder for shooting 20-year-old Kaylin Gillis on a Saturday night last April after she and her friends pulled into his long, curving driveway near the Vermont border while they were trying to find another house.

The group’s caravan of two cars and a motorcycle began leaving once they realized their mistake. Authorities said Monahan came out to his porch and fired twice from his shotgun, with the second shot hitting Gillis in the neck as she sat in the front passenger seat of an SUV driven by her boyfriend.

During the trial, Monahan and his attorney maintained the shooting in the rural town of Hebron, about 40 miles (65 kilometers) north of Albany was an accident involving a defective gun.

What made him so paranoid?

I'm 5 years older, live with the Skippa, and I'm on a road that people take when they are exploring the area (actually, it's my drive way).

I have an Agawam Arms .22 single shot (a birthdate gift from my Dad, back in 1972) with no ammo and a slingshot with 500 rounds of 3/4" clay balls for zen targets. Fabbed Steel/Cast iron components hung for me to nail and make a sound..... 75 feet from my deck.

Relatively long driveway here off a dirt road. People occasionally drive down it in the summer, out of state tourists mostly, but they quickly notice the house and garage, back up and drive away. Sometimes, if I'm outside on weekends they'll ask directions. Shooting at them really never occurred to me. I don't get it. I really don't.

to be charged when someone pulled into his driveway (at the end of suburban cul de sac) to look at his phone, and the guy shot him. Still awaiting the trial, and the only reason he probably was charged was the foreign national's country screamed to high heaven.

I just looked it up and he got convicted of manslaughter (it was murder in my mind like this case).

Family members of Dghoughi, who lived in Austin, have said he was lost and prosecutors said he was trying to leave the driveway when he was shot.

Turner said he shot in self-defense and testified that he thought Dghoughi pointed a gun at him, but no weapon was found inside the vehicle. Turner testified that he was concerned someone was trying to rob or harm him when he saw a strange vehicle in his driveway about 3:30 a.m., grabbed a gun and then went outside to confront the driver,

Looked up additional details. SIX FUCKING MONTHS. YOU GOT TO BE KIDDING ME.


The 67-year-old Turner will spend six months in jail after he shot and killed Dghoughi in October 2021. Judge Chris Schneider said Turner must serve the first 140 days immediately. He'll then return to jail for two days on the anniversary of Dghoughi's death and repeat the process on Dghoughi's birthday.

Wouldn't a normal reaction in this situation be to hunker down inside your house and call the police? The only reason to grab your gun & exit is because you're looking for a confrontation and a chance to shoot someone.

Also a case could probably be made that the car was still in the easement part of the driveway (at least in part). All the man did was back up to get away from the nut with a gun. Texas is fucking insane, and this case didn't get nearly the press that it should have. Morocco should have been livid. It is pretty typical of the South though (the India man who had his neck broken by a cop and the Japanese man gunned down on the doorstep of a residence on Halloween).

Google doesn't seem to know my address. I have a long driveway that looks like a dirt road.

You would be surprised at how many people get to my gate and realize they got the wrong house. Google can't lead them there. So, I don't know how they manage to get so lost. But they do. And I never shot at a single one of them.

This guy must have some amount of people getting lost at his place at one time or another. He has to have had people lost on his driveway before. Why the sudden lethal attack? That's what makes me wonder. Why did he shoot to kill this time?

not surprising that he was convicted. you don't just go outside and shoot someone for being on your driveway!

i think that some gun nuts, not all of them, but some of them, secretly itch to blow someone away. too many of them.

but he DID intend to point the gun at the car... and the person inside the car.

Never mind that he very likely pulled the trigger. If he wanted to scare off "intruders' he could have walked out onto his porch WITH the gun pointing at the ground... or at the very most, fired a shot in some other direction than the car(s).

But he aimed the gun at the moving car, probably leading it a little bit to make sure he hit the car and the occupants. At that point it really doesn't matter if he pulled the trigger or the gun misfired. It was intentional and therefore, murder.

How's that for a "well-regulated" militia? If you have a gun, according to the 2A, you need to be well-regulated and trained. Keep that gun non-defective. Do defective guns just go off without someone pulling the trigger? Do defective guns self-aim at targets?
