Backed by Elon Musk, Gina Carano sues Disney over 'Mandalorian' firing
Source: NBC News
Actor and former professional MMA fighter Gina Carano has sued The Walt Disney Co. and Lucasfilm over claims she was wrongfully fired from the series The Mandalorian in 2021.
In the suit, which was filed Tuesday in federal court in California, Carano alleges she was fired from her role as rebel warrior Cara Dune for voicing right-wing opinions on social media. She is seeking a court order that would require Lucasfilm to reinstate her or compensate her at least $75,000. Carano claims in the suit that she suffered emotional damage and lost millions of dollars in income.
A short time ago in a galaxy not so far away, Defendants made it clear that only one orthodoxy in thought, speech, or action was acceptable in their empire, and that those who dared to question or failed to fully comply would not be tolerated, the lawsuit says. And so it was with Carano.
X is helping cover the costs of the lawsuit, Carano confirmed Tuesday in a post to the social media platform.
I would like to express my deepest gratitude & thank you to @ElonMusk & @X for giving me an opportunity to bring my case to light, she wrote.

Please be advised. Political ideology, and party are NOT, repeat, NOT a protected class, so I hope her termination is of extreme prejudice.

Anything deemed controversial or harmful to Disney would get you fired. So the BS I was dropped for right-wing thought is nonsense.

(156 posts)Understand the first amendment and freedom of speech relates to the government, not private companies, preventing or retaliating against what you say.
If you are an actor on a series, you automatically become a spokesperson and face of the series and therefore the company who carries the series. If Disney doesnt like you spewing RW bullshit, they are perfectly within their right to fire your dumb ass and never let you work for them again.

(1,065 posts)Tesla used to be on my list as far a new cars go. But he fucked up. Instead I stuck with Audi and got a mild hybrid this past year. My Audi dealership has been great to me for over a decade. From what I have seen in that time, Tesla's customer service is not anything close to Audi's. Then there's this:
When Musk rejected his own daughter due to his anti-LGBT views, that was it for me. He deserves not one red cent from me.
Now this. Tesla is not only off my list, but I hope the company goes down in flames.

Then see how much of his 13% tesla The Odor can hold onto. The company could be good without him.

It rather depends on how she spoke out, in what forum it was seen or heard, and to some degree what the public response was.
Disney is well known to have VERY tight guidelines on such things and to be VERY aggressive in protecting their franchise.

She is not recovering perceived damages. She is letting herself be used as a tool of Musk. She should be aware that Elon doesn't give a tinker's turd about her or her career. He is just satisfying grudges and will discard her if convenient.

I dont think shes going to lose the suit. I think the case is going to be thrown out before it ever gets to trial.
Shes only doing this because a prosperous career in the right-wing hate bubble didnt pan out after Disney dumped her ass. She made a film that grossed something like $13,000 nationwide. Nobody wants to see her shitty acting.

(9,350 posts)Do you think they will just pay her to get it over with and save money? She is only asking for $75,000. I assume she will lose if it goes to court, but it seems like it would cost Disney more than $75,000 to defend against his case. What so you think Disney does?

...and Carano will back down, because she doesn't have a legitimate wrongful termination argument, and she stands to lose a lot of money in legal fees.

(17,863 posts)California code prevents employers from restricting participation in politics.
Also I think she potentially has a case for defamation from this quote attributed to Disney management:
Nevertheless, her social media posts denigrating people based on their cultural and religious identities are abhorrent and unacceptable.
The goal of the lawsuit is to get to discovery where it becomes apparent that Disney management has a group think attitude towards a specific political position (in this case a liberal one that attempts to be more inclusive and accommodating). That combined with the backlash towards the approaches taken that seem to single out straight white men as the only (or primary) privileged group that further forms a narrative that Disney isn't interested in that group for its products and services.
I don't see much of a case her for her, but that isn't the goal.

(66,379 posts)California is an at-will employment state, meaning either party can end the employment agreement for any reason or no reason. If Carano accuses Disney of firing her because of her political beliefs, Disney can either respond that that wasn't the reason she was fired, or they can simply invoke the at-will law, meaning they don't need a reason to fire her at all.

(1,332 posts)But this law clearly focuses on activity like voting, volunteering, running for office, and participating in protests. There are no laws in the books that protect political ideology, affiliation, and party on the federal nor state level. So if you open a business that only accepts democrats only, it is legal.
