Former President Donald Trump ramped up his threats to prosecute President Joe Biden if he wins another term in the White House.
An appeals court rejected Trump's claims of immunity in the federal election subversion case in the District of Columbia, although he intends to press the same argument in Florida, where he also faces federal charges for mishandling classified documents, and the ex-president issued what appeared to be a "blackmail" threat against his Democratic rival.
"If a President does not have Immunity, the Opposing Party, during his/her term in Office, can extort and blackmail the President by saying that, 'if you dont give us everything we want, we will Indict you for things you did while in Office,' even if everything done was totally Legal and Appropriate," Trump posted on Truth Social.
Trump has made clear that he would use the Department of Justice to target his enemies if re-elected, and he listed some of them by name..............................

(2,965 posts)When Trump asserts this defense, it will first be heard by Cannon who, I have little doubt, will find that citizen Trump has all kinds of immunity.
The appeal will go to the 11th Circuit Court of Appeals. The decision of the DC Circuit Court of Appeals is not binding on the 11th, which can decide any way it likes. If its decision is contrary to the DC decision, there will be a split in the circuits which will all but guarantee that the Supremes take the case up.
It's also possible that the Supremes will review the DC opinion. The Florida immunity claim would get put on hold pending word from the Supremes.

They can do that right now. Obama could have prosecuted W for torture and spying on American citizens. Ronald Reagan was prosecuted for the Iran-Contra affair....though he was too far into dementia to remember anything.
So presidents have and can be prosecuted for breaking the law while president. It hasn't made the office weak or ineffective.
