The Biden administration is considering taking executive action to deter illegal migration across the southern border, according to two U.S. officials. As passing legislation on border security in Congress appears unlikely, the plans under consideration signal that the White House wants to take action before numbers at the border, which have dropped in the past month, rise again as expected.

The plans have been under consideration for months, the officials said. In December, as Congress prepared to leave town for the holidays with no border solution, illegal crossings of the southwest border hit records at more than 10,000 per day.

The unilateral measures under consideration might upset some progressives in Congress, the officials said, but they noted that Democratic mayors who have asked for more help from the federal government to handle the influx of migrants in their cities would be pleased. The measures are still being drafted and are not expected to take place any time soon.

On Wednesday, Senate Republicans blocked a bipartisan border bill that they had negotiated with Democrats and the Biden administration over the preceding months. In a statement, a White House spokesperson said, “The administration spent months negotiating in good faith to deliver the toughest and fairest bipartisan border security bill in decades because we need Congress to make significant policy reforms and to provide additional funding to secure our border.”

This has obviously become a liability for November… but the status quo allows the administration to argue that republicans were blocking a plan that would work.

If the president takes executive action and it actually has an impact… particularly if it is in any way similar to the former administration’s actions… how could that do anything but cause “why didn’t you do that all along???”

that was challenged and upheld... at least administratively (due to a faulty repeal by E.O.) until it was halted again (for the moment) while still waiting higher court reviews and/or Congressional action (i.e., passage of some "Dreamers" law).

But during the period it was in effect, it had some impact, like Title 42 - another thing that was inserted in an E.O. as part of a declared "Health Emergency" (related to COVID-19) that had "immigration" impacts, that came and went, came and finally went bye bye in the courts as "moot" when the "Health Emergency" was ended). But during the time it was in effect, it had an impact.

One might recall the court fate of the "Executive Action" of cancelling "all" student loans (and what has been going on to recover from that).

He clearly has it under existing law. This isn’t a case of arrogating legislative power to the executive branch (which was the case with student loans, housing, etc.)

..."I was hopeful Republicans in both houses would approve the deal their chosen member negotiated in good faith, but since they have left me with no other options, I am taking executive action to address the issues they have been unable, or unwilling to." His approval ratings would go up 5-6 points in a matter of a few weeks.
