WASHINGTON Newly unearthed footage from Jan. 6, 2021, appears to show a rioter a man identified in an NBC News story nearly two years ago firing a gun into the air outside the Capitol during the attack.
Online sleuths who have aided in hundreds of Jan. 6 prosecutions say he is the same man they identified to the FBI who is currently individual No. 200 on the bureaus Capitol Violence page, which he first appeared on three years ago. Videos and photographs from the Capitol on Jan. 6 showed him with what appears to be a gun in his waistband. As NBC News previously reported, that man, John Emanuel Banuelos, told Salt Lake City police that he was at the Capitol and had been captured on film with a gun. I was in the D.C. riots, he told the investigators, according to a police transcript. Im the one in the video with the gun right here.
Banuelos has not been arrested or charged in connection with Jan. 6; the Salt Lake City police had arrested him in connection with the fatal stabbing of 19-year-old Christopher Thomas Senn in a park on July 4, 2021.
Man, should I just tell the FBI to come get me or what? he asked Salt Lake City police officers, according to a police transcript. Weeks later, Banuelos called an investigator with the department and talked about going where Donald Trump sent him, apparently referencing the Capitol, according to a police record. The Salt Lake City DAs office did not pursue a case against Banuelos, who claimed self-defense in Senns death.

(55,334 posts)It's a dangerous reckless act and should be prosecuted, but shooting a pistol in the air doesn't warrant a long prison sentence. Other J6 rebels mostly got 6 to 24 months.
We don't need to cross that cruel and unusual punishment line when the offender isn't a ringleader

(94,215 posts)Another Jan. 6 participant, Jerod Bargar, dropped his gun in the mob and was recently sentenced to five years of probation, with six months of home confinement. The officer who recovered Bargars weapon on the ground was aware of multiple reports of firearms in the crowd, according to prosecutors. Trump also knew the crowd was armed, his former aide Cassidy Hutchinson testified before the House Jan. 6 committee in 2022. He urged security to remove the magnetometers at his rally that morning, she testified, adding that Trump yelled: Theyre not here to hurt me.
Because so few rioters were arrested on the scene on Jan. 6, there will never be a full accounting of how many of the rioters were carrying guns and other weapons.

Let them spend the rest of their miserable lives nervously looking over their shoulders all the time.
Never knowing if and when the ax might fall.
As it surely will for some of them.

Has anybody considered how the peace and domestic tranquility might look if Trump were to blanket pardon all these patriots? Have the USSC judges thought that one through, ya think?

(7,790 posts)if all the exonerations for Trump just means they'll let these insurrectionists go now, and stop prosecuting them. I mean, what's the point anymore? If you let the main insurrectionist go...
Yippers... Putin's won. And you know what? I don't care. I won't let these Southern Fried Catfish take over my country. I served my time in the US Air Force. I'm a veteran... and that's for life. All enemies, foreign AND domestic. They ain't gonna make my country the Confederate States of America. They've already done more than enough to us women, and we (especially us women vets) are going to take back our autonomy. But so will every other minority who's served in this woman's military. They want a war? I may no longer be a sharpshooter, but I bet I can still hit broad mass! And for one of these traitors, I'll feel no regret at the time. It's war they want, it'll be war they get. Shut down their military bases. Pull back their equipment. Stop the flow of money to their states. Diplomacy first. But if that fails, then they pay the cost for the loss of the country. If they don't like it, let them go live in Russia or Hungary and pay homage to Putin or Orban and see how they really like it. I'm done with them!
