Trump asks appeals court to stay $454 million judgment until his appeal is over

CNN Former President Donald Trump asked a New York appeals court on Wednesday to delay his obligation to post $454 million until his appeal of the civil fraud verdict is over.
The judgment order unprecedented and punitive disgorgement of nearly $460 million and overbroad permanent injunctive relief against Appellants in the absence of legal authority or factual support, Trumps attorneys wrote in the filing.
Trump has less than 30 days to post the money to prevent the New York attorney generals office from taking steps to execute the judgment, including potentially move to seize properties. It is not yet clear how he plans to cover the payment.
The urgency of this application is evident in light of the punitive and exorbitant disgorgement awarded against Appellants, the impact of the injunctive relief upon lawful businesses, the uncertainty created by the vague and overbroad directives Supreme Court issued, and the Attorney Generals public threats that she will seize Appellants real property forth with to satisfy the Judgment, Trumps lawyers said in the new filing.

He could find that money under the sofa cushions in one of his mansions of the sort that nobody but an extremely rich person would own. I don't understand why he's complaining about posting an appeal bond that wouldn't even make a dent in his vast financial empire. It couldn't possibly be that he doesn't have the money.

(106,211 posts)The judge clearly had legal authority to try the case and impose a fine, and the factual support was the evidence in the case. I can see they can try to argue about "punitive and exorbitant", because that's about the amount (as the joke goes, "we've established that, now we're just haggling over the price" ), and that has a lot more variability. Though I'd say that "the vague and overbroad directives Supreme Court issued" indicate the judge can do a lot (and if it was the Supreme Court, presumably that can't be appealed). And it's surely the AG's right to seize property if they don't pay in time. Whether the businesses are "lawful" is arguable, after the verdict ...

I made sure I bought Red Wing because they were made in America. I paid a lot more for them but they were the best, The most I paid back in 2009 when I was working was around 200 dollars.

I think the court should ask him to disclose his tax circumstances before considering this.
If the state waits much longer they might not see anything.

(541 posts)If Trump fails to put up the bond, then 30 days after the judgement is entered, she can begin collection actions to satisfy the judgement no matter what is going on in the appeal.
The interest accumulates until the penalty is paid or overruled.
