Supreme Court agrees to consider Trump immunity claim in further delay of election interference trial

WASHINGTON The Supreme Court agreed Wednesday to decide whether former President Donald Trump can claim presidential immunity over criminal election interference charges, adding a new hurdle to a trial taking place.
The court said in a brief order it would hear arguments and issue a ruling on the immunity claim. In the meantime, the case is on hold, meaning no trial can take place.
The order said the court would hear the case, which could take months to resolve, the week of April 22. That timeline allows for a ruling by the end of the court's regular term in June, which is faster than is typical when the court hears arguments but not as fast as prosecutors wanted it to be.
The legal question the court will decide is "whether and if so to what extent does a former president enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office," the order said.

And, of course, the Republicans are planning to get the election tossed to the House. If it goes to either the House or the supreme court it seems likely that he will have the votes.

fast forward 2024...Trump's MAGA base is stagnant...Republicans in the swing states are sitting out the primaries, Trump is under criminal indictment, he's an adjudicated rapist/guilty of tax fraud and he's financially fucked.. his rallies are sparse, he's spewing Nazi/racist vomit and the MSM is no longer his fawning bitch, parsing his verbal dreck..now he's "unhinged/deranged, underperforming"..when FOX is fact- checking Trump's bilge in real time that's not a good sign..

Jack Smith asked the Supreme Court to take the appeal right after the district court gave its decision. The Supreme Court denied Smith's appeal to take the immunity case, but sent it back to the Appeals Court. Then the Supreme Court decides, well maybe, it will take the appeal after all.
Jack Smith's J6 trial is dead in the water.

(1,306 posts)I've stated several times here that SCOTUS would pull something like this, and was bullied, shouted down and made to feel pretty unwelcome for stating such... to the point that I pretty much quit posting about anything and almost didn't re-up my "membership" when it came due.
So, here's a big, "told ya so," to all those who hounded me.
The way to tell what a republican will do, in any situation, is to look at the action that will most help him, her, or another republican regardless of whether it is against precedent, law or common sense. This SCOTUS will find a way to declare his actions immune, but only for him, and they will twist all reality and logic and legality to do so. Guarantee!

Their acceptance of this appeal is inexcusable. They had very little credibility, but even that is gone now. The Republicans hacks on the Court should be happy that theyve given Trump the delays that he wants.

(10,085 posts)With the DC court finally ruling, and many here saying it took so long because they wanted to make it bulletproof, all the SC needed to do was affirm their ruling. Instead they are now allowing Trump the delay he wanted, with the likelihood that no trial will start before the election since the SC may not release its decision until the end of the current term in June. Scheduling a trial, and I think I read 88 days for preparation, selecting a jury, and holding the trial takes months, not a few weeks. And we do not know how the DOJ would view starting a trial a few weeks before an election.

The one thing he didnt do is what many are complaining that the the court didnt do he didnt suggest they treat Trumps application for stay as a cert petition and deny. Instead he told the court they should treat it as a cert petition and grant it. I dont blame him because it always was all but inevitable that on a case as significant as this that the court would decide to hear it.

4- restore reporoductive rights

Lastly he can then order SCOTUS to reverse the Presidential immunity to only while in office.😎

Not sure if I've got his phraseology correct, but it did contain those words (i.e. Corrupt REPUBLICAN Supreme Court Justices[) in that approximate order uttered with extreme insistence.

(1,295 posts)It seems totally corrupt to not rule on this when Jack Smith requested it in December if it WAS something that they were willing to consider. It would be interesting to know if the decisions in December and now were 6-3 or 5-4 because 5-4 would mean that one of the Rethug justices ruled against Trump and just one more is needed to reject the immunity claim. If it was 6-3, it could be a higher hurdle.
Refusing to rule on the issue in December and then agreeing to take it up now is a lot like Mitch McConnell refusing to have hearings for a replacement for Antonin Scalia when he died in February because it was too close to an election, but then ultra-fast tracking the hearings when Ruth Bader Ginsburg died on September 18th, 6 weeks before an election. It's pathetic that the "conservative" SCOTUS members are now as blatantly partisan as the Senate.
This country could really use a new constitutional convention to get rid of the electoral college and introduce term limits and conflict of interest rules to the Supreme Court and a bunch of other things.
