As Trump Seeks Trial Delay, N.Y. Prosecutors Offer 30-Day Postponement

Less than two weeks before Donald J. Trump is set to go on trial on criminal charges in Manhattan, the prosecutors who brought the case proposed a delay of up to 30 days, a startling development in the first prosecution of a former American president.
The Manhattan district attorney's office, which accused Mr. Trump of covering up a sex scandal during and after the 2016 presidential campaign, said the delay would give Mr. Trump's lawyers time to review a new batch of records. The office sought the records more than a year ago, but only recently received them from federal prosecutors, who years ago investigated the hush-money payments at the center of the case.
In response to the new records -- tens of thousands of pages of them -- Mr. Trump's lawyers requested that the trial be delayed 90 days. Although the former president frequently requests such delays, prosecutors consenting to any postponement makes one far more likely.
Mr. Trump, who clinched the Republican presidential nomination for the third time this week, faces four criminal trials and several civil lawsuits. The Manhattan case had been the only one of the four criminal cases not mired in delays. Now it too appears likely to be postponed, though it remains on track to reach trial before Election Day.

Less than two weeks before Donald J. Trump is set to go on trial on criminal charges in Manhattan, the prosecutors who brought the case asked a judge on Thursday to delay it up to 30 days, a startling development in the first prosecution of a former American president.
The Manhattan district attorney's office, which accused Mr. Trump of covering up a sex scandal during and after the 2016 presidential campaign, proposed the delay so that Mr. Trump's lawyers could have time to review a new batch of records. It only recently obtained the records from federal prosecutors, who years ago investigated the same hush-money payments at the center of the case.
The potential postponement of the trial, which is scheduled to start with jury selection on March 25, would represent the latest delay on Mr. Trump's sprawling legal docket, which includes four criminal cases and several civil lawsuits. The Manhattan case is scheduled to be the first to reach trial, and might be the only one to do so before Election Day. A criminal case against Mr. Trump in Washington, where he is accused of plotting to overturn the 2020 election results, was initially supposed to go to trial this month, but that is delayed while Mr. Trump appeals to the Supreme Court.
A delay in the Manhattan case would most likely delight the former president, whose central strategy for fighting all of his legal entanglements is to stall as much as possible. If he is elected to a second term in November, the criminal cases against him would grind to a halt until he is out of office. Still, the judge overseeing the Manhattan case, Juan M. Merchan, will have to approve the delay, and he has made a point of pushing the case forward at every turn. It is unclear when he will rule. And until he does, it is unclear how Mr. Trump's other cases might be affected.

Second, it throws a wrench in any plans or scheduling that dickhead trump and his legal might be working with.

(32,065 posts)The case is 8 years old. In my experience, unlike TV, prosecutors almost never want to go to trial. That is why there is so many plea bargains. I have said before it is the prosecution which delays criminal trials more than the defense.

(32,065 posts)And what "new stuff" is in those records? The feds looked at the same case Bragg did. So, its not really "new stuff". The prosecution should have anticipated this. After 8 years.

I'm not a lawyer either, but I assume additional evidence is a good thing in a prosecution.

This case goes back to what Michael Cohen was charged and served time for that PRE-DATED Bragg's time (Cyrus Vance, Jr. was the Manhattan D.A. at the time).

(4,274 posts)I think it's likely that the judge will grant well more than 30 days. Then will come all kinds of motions based on the new content etc. so I have little to no faith the trial takes place before the election. The defense is going to make a strong case about dismissal/exclusion based on the delay by SDNY. Gee it sounds like someone(s) set things up to give a certain someone ammo to claim unfairness and people trying to "hide" things that could help him.
