Supreme Court allows Texas to enforce immigration law

WASHINGTON The Supreme Court on Tuesday allowed Texas to enforce a contentious new law that gives local police the power to arrest migrants.
The conservative-majority court, with three liberal justices dissenting, rejected an emergency request by the Biden administration, which said states have no authority to legislate on immigration, an issue the federal government has sole authority over.
That means the law can go into effect while litigation continues in lower courts. It could still be blocked at a later date.
"The court gives a green light to a law that will upend the longstanding federal-state balance of power and sow chaos," liberal Justice Sonia Sotomayor wrote in a dissenting opinion.

(22,577 posts)as well as giving us the national nightmare of Trump. In 2016 there were only 2 people who could win the presidential election: either Hillary Clinton or Trump. That's it. So any Democrat or voter on the Left who did not vote for Hillary in the swing states only helped Trump. It's choices and consequences: you made the choice and the rest of us who did vote for Hillary as well as many others have suffered the consequences. Nice job.

(1,128 posts)Because there's a far easier and violence-free way to make him regret taking this path:
Putting the onus of all immigrant arrests Texas makes on Texas. They will need to house the detainees until their kangaroo hearings, conduct the kangaroo hearings, and then pay the costs of the deportation, too. State arrests? Then state money needs to pay for it all, and not one dime from the feds for it.
Texas doesn't have enough law enforcement officers to provide border patrol and address normal LEO duties, too--and even if they could provide the personnel, they don't and won't have the money to pay for it all.
Let him learn it the hard way.

But as this isn't a rogue state, he'll try to ship'em to some blue state - and if that fails, he'll dump'em in the streets of Houston or Dallas.
Cities which, to many TX Republicans, have been "lost" anyway.

(16,399 posts)It must suck to be one of the liberal minority right now. Jackson, Kagan, and Sotomayor are powerless to stop the majority from doing horrible things. I'm glad they are there to write well-reasoned dissents to the crazy ass decisions the others come up with, but Biden REALLY needs to expand the court in his second term, before the Sucky Six drag this country down any further than they already have!

Make them cover the costs of hearings and housing until the hearings, and processing and transporting them for deportation.
Hey--give them what they want, control over the immigration process...and all the costs associated with it, too.

(2,023 posts)Not agreeing just sayin'. I know what Sotomayor is saying but in my simple minded law world it would seem we better legalize pot at the federal level pretty quick if we want to honestly retain federal law is the final law of the land. Or maybe it works in some way I don't get.

start by cutting texas off from any federal money. (and i live in texas). for instance the massive wild fires in norther texas? no federal aid. not 1 one penny. If texas can afford to waste money on its immigration crackdown it can afford to pay its own way 100%

(83 posts)What happened previously when local police encountered migrants who were not here legally? Detain until they could turn them over to the federal authorities?
Now when local police arrest them, will they be processed differently than if arrested by federal authorities?

(367 posts)Time to cut the Federal funds off and move the military bases out of Texas. Block off all Federal Highways at the Texas Boarder. No airplanes or trains over the Texas Boarder. Personally I'd kick them out of the Union. No Social Security checks for Texans. Let's make Texas a bigger hell hole than it already is!!! Just a modest proposal.

All of it. Including the expense of it. But we won't do that, because the cratering of the Texas economy from the loss of that sweet, sweet federal cash would bring down the rest of the country, too.
On the other hand, a gradual, but emphatic, withdrawal of federal border funds would still send a message: You don't need us handling migrants? Good. We have better ways to spend this bit of federal money...And, oh, this bit, too... And now this, this and this...
And--what's that? You want your funding back? But we're giving you what you wanted, which was securing the border yourselves. Why do you want our help now, when you said you could do it so much better than we could?
So show us all how it's done. We eagerly await the results. Just don't expect us to provide the lion's share of the funding for it if you want the lion's share of the control.

(26,739 posts)SCOTUS wasn't asked "will you block this law?" - They were asked "the 5th circuit said that the law could be enforced while they wait to hear the case... will you force them to change their mind?". SCOTUS said no... but they didn't say that the 5th circuit couldn't change their own mind (which they have done because the oral arguments begin today)
