Ohio Moving to Exclude Biden from Ballot

In 2010, the Ohio legislature passed a law creating an arbitrary deadline that candidates for each political party must be nominated 90 days before the election to get on the ballot. That provision has never been enforced to keep a candidate off the ballot - until now.

Both the Republican and Democratic National Conventions took place after the 90 day Ohio deadline in 2012 and 2020. Both times the legislature passed a bill to extend the deadline so there were no issues. However, 2024 is the first time that only one party has their nominating convention after the deadline, and it just happens to be the Democrats which will nominate Biden on August 22, two weeks after Ohio's arbitrary deadline.

The Republican supermajority was asked again, just like in 2012 and 2020, to extend the deadline so there will not be an issue. They have refused to do so. Now, Republican Secretary of State Frank LaRose has just send a letter to the Chair of the Ohio Democratic Party stating that he does not believe the legislature is going to grant an extension so the DNC is going to be forced to either change the date of their nominating convention to satisfy Ohio Republicans, or take them to court.

The Biden Campaign and the DNC has been largely silent on this issue, apparently attempting to resolve this behind the scenes through negotiations. However, LaRose's letter makes it clear that the time for a settlement to this appears to be at an end with Ohio Republicans prepared to force Democrats to take them to court...........................

since the DNC convention is after their arbitrary deadline.
OH extended the deadline for Repubs in 2012 & 2020, but refuses to do it now. Story.

The constitution doesn't even require an election for the presidency. A state legislature could pass a law making their electors selected by a committee, or appointed by the governor.

So I doubt a filing deadline for an election would be unconstitutional.

It's stupid, of course. And the not granting a waiver but is obviously being done for partisan reasons, no way would they be dropping Donnie from the ballot if it was the republicans who had the later convention.

But i don't see how it's unconstitutional.

In Donnie's case, the Supreme Court held that only the federal government can enforce disqualification *for the reason of having been an insurrectionist* because their interpretation is that the 14th amendment meant for the federal government to enforce that rule.

That in no way means that states can't have filing deadlines and other criteria such as a minimum number of signatures.

I'm actually wondering how it would play politically if we more or less let this happen. It might bolster the argument that republicans are fascists, don't believe in democracy, etc.

Which might help us in the actual battleground states.

If they've ever made an exception for one side because they had their convention late, then they can't deny a waiver for the other side if their convention is late.

That's exactly what equal under the law is about. Ohio can't treat A one way and B another just because some schmuck with delusions of grandeur wants to.

Only difference is this year one party - the ruling party - planned their convention before the arbitrary date they had ignored before, premeditating their move to bar the current president and presumed candidate from the ballot. Winner-takes-all means that there are substantial swaths of voters whose votes never really count.

And, yes: It works both ways. There would be, for instance, some Republican electors from California. And some Democrats from Texas.

But all in all, an apportioned elector system is much more like representative democracy.

One has to wonder how it would impact Sherrod Brown’s reelection campaign. On one hand you could imagine a negative impact on Dem voter turnout. On the other hand, La Rose was smack dab in the middle of the attempt to thwart the Reproductive Rights amendment vote last year. Here he is once again with the rest of the GOP. Could this backfire and increase turnout for Dems.

it is fine to exclude Biden, then California and every major blue state with a Democratic majority needs to pass a law in their state legislatures to exclude trump from the ballot, and that will be the start of a real civil war.

Of course a better approach would be to just have a virtual Convention before the scheduled Convention to nominate the Democratic President.

Enough is enough, there is no point in waiting any longer.

They are NOT kicking Biden off the ballot because his party's convention will occur after the date they have just set for printing the ballots. So clearly this is NOT the reason they are kicking Biden off the ballot. Democrats should get this decision blocked right now. The suggestion of a virtual Democratic Convention seems like a good idea. Then the later real Democratic Convention could still be held as a glorious bonding festival!

Sure, have a 1-2 day celebration of the official nominees if people want. But there’s really no reason why we need a week-long convention just for a formality.

Lisa Murkowski managed to win her Senate seat one year when she was a write-in. Biden is a lot easier than Murkowski to spell.

Why can’t the delegates do a zoom conference meeting 88 days before the election when President Biden receives enough votes to secure the nomination. Pass the nomination from the delegates to the Ohio congress, use this as an “ October type surprise” push to take the Ohio congress, and pass new legislation. Perhaps after the last primary in June, a special delegate zoom can be officially announced by the DNC and the nomination can occur.

The congressional races are over before the 1st vote is cast because of gerrymandering.

The republican speaker of the House in Ohio is in prison for his part in taking in 62 million dollars
in bribes in order to get the utility companies 1.6 billion in kickbacks.

The Ohio Democratic Party is the quintessential “limp groom on the wedding night.”

And with a woman’s rights being on the ballot the GOP will make sure the state stays red.

And registered voters (black and democrats) are always being dropped from voter lists.

Interstate cross check is still being used.

When a really good doctor worked to stop the spread of C-19 gun toting mouth breathers
Showed up in her and her family’s yard and Mike DeWine didn’t do shit so she had to quit
her job as director of the State’s Department of Health.

And I forgot Ohio 2004 and the election that was stolen and when a federal judge said that
the people had the right to see the County’s BOE records from the election in many counties
the Republicans just threw out the paperwork and poll logs. In one county* that said that a
coffee pot broke and so they had to throw away the materials because people might get cut
from the broken glass and in another county** they ordered new poll logs, ballots, and what
not which they filled out in order to match last fall’s election results.

This sounds like a violation of the election law, if Colorado is forced to keep Trump on the ballot then Ohio should be forced to.

usually the courts are pretty much bought. Waiting for other States to find any myriad of reasons. And no matter taking this or that to court, they will make certain by cheating and lying to win.

I may sound pessimistic but cannot anyone see how they are more than setting up to make sure X45 will be "ruler"?

I am really sick to my stomach at this point. Actually have a stomach ache right now. I am also angry that our system is putting up with this because it is showing flaws. Disregard for our country. Disregard for the whole planet really.

Whomever set the date for this year's convention is at fault since the law was in effect for 14 years. That's gross incompetence.

Both parties had late conventions in 2012 and 2020 so it wasn't a partisan issue and the deadline was extended, or else Ohio wouldn't have a vote for the president.

cropped up, in different states, and with both parties. Previously it was always resolved. I think that most people believe that it will be resolved this time too. However, in the meantime, it is a huge amount of excrement launched into the electric oscillating appliance. At a minimum this is a huge waste of the Democratic party's energy. I think that the chaos is the plan.

This isn't a tough one to find out.

Of course if the Ohio republicans were decent people, they would work with the Biden campaign on this.
2nd question.... Who was assuming republicans are decent people?

I know somebody better do something. The Ohio Democratic Party was informed of this months ago. I know this because I first heard of it almost three months ago.
