Georgia appeals court temporarily halts Trump's 2020 election case in Fulton County

Washington -- The Georgia Court of Appeals temporarily halted proceedings in the 2020 election case involving former President Donald Trump while it reviews a trial judge's ruling that allowed Fulton County District Attorney Fani Willis to continue prosecuting the case.
The stay issued by the court applies only to Trump and the eight co-defendants who sought to have Willis and her office removed from the case because of an improper relationship she had with Nathan Wade, who served as a special prosecutor.
A panel of three judges on the appeals court is tentatively set to hear arguments in the disqualification bid Oct. 4. The case is being heard in its August term, and a decision must be rendered by March 14, 2025.

(12,262 posts)As many have predicted, trump will largely escape any accountability. The court system is just not capable of holding wealthy and/or privileged people accountable.
I'm not optimistic on anything.

(998 posts)Guess this case is essentially dead. Shame because the charges against Trump are a slam dunk.
And Cannon's never going to allow the Florida case to go to trial.
It's all up to our MAGA Supreme Court now. They're taking their sweet time and probably will come back with some ambiguous ruling in July about presidential immunity. They'll send everything back to the lower courts in DC to sort it out. Delay, delay, delay.
If convicted felon Trump loses in November the DC trial will eventually happen. The Georgia case will get thrown out by the conservative court of appeals or Fani Willis will get removed from the case.
Convicted felon Trump portays himself as the ultimate victim. He's the luckiest MF'er in the world.

(11,792 posts)I'm afraid I failed to follow this story very closely. I think I read that DA Willis is alleged to have a conflict of interest in attempting to prosecute Trump &/or his supporters. I never understood that a DA was supposed to be neutral in the first place they represent the people, not the defendant, conflict of interest or no; and if the DA thinks the defendant is guilty, I'd have thought the last thing they're supposed to be is neutral I thought it was just the judge and jury that were supposed to be neutral, not the DA. I thought the whole conflict-of-interest thing is a non-issue where they're no duty of impartiality to begin with.
That said, I realize that a DA may have a duty to share evidence that might exonerate the the defendant the DA isn't supposed to prosecute people in bad faith.
Is the objection to Willis that she did not share exonerating evidence? Or does she have an obligation of neutrality that I'm not aware of?
Sorry for my obtuseness/ignorance; thanks for any help.
I'm disappointed because I thought this case might have been the strongest one against Trump.

(21,496 posts)DA Fani Willis and her lead prosecutor (Nathan Wade) for the Georgia Rico case were accused by several defendants of financial impropriety. They alleged that DA Willis was shuttling exorbitant payments to Wade that was paying for him taking on her vacations et al while they were dating. The judge (Scott McAfee) ruled there was no financial impropriety, but that DA Willis and Wade were wrong in having an affair. His ruling was that one of them would need to step down from the case. Wade was the one who stepped down from the case (note: had DA Willis stepped down, the whole case would've needed to start all over under a new DA).
DA Willis/her prosecution team turned over all discovery info to trump and 18 co-defendants in September/October 2023.
trump/some of the defendants have put in an appeal that states that DA Willis should have been disqualified, not Nathan Wade.

(11,792 posts)what was the basis for the judge's ruling that the affair between Willas and Wade created a problem? Would it be a problem if Trump's lead attorney had an affair with one of her/his underlings, or if Trump had had an affair with one of his attorneys? Unsavory, yes; but so long as the affair was with someone on the same "side," there is no conflict of interest, and I haven't heard of any other legal principal that would serve as a basis for disqualification.
Perhaps a DA is in fact supposed to be neutral? But wouldn't that conflict with her duty to prosecute those who break the people's laws?

(6,115 posts)This, like the stolen documents case, is easy to prove because there is a ton of evidence - including audio files and emails. They both are slam-dunk cases considering all the evidence; even easier to prove than the NY case we just saw.
What I don't understand is why this should derail the case. She is not prosecuting it, and the people who are prosecuting it have nothing to do with her former relationship with Wade. Willis didn't indict the motherfucker; a grand jury did, and then her office took over. She is no longer involved. And the people in her office have nothing to do with the bullshit accusations against her.
This is a pure hit job on a powerful black woman who is enforcing the laws on the biggest racist in the country.

They're just playing the game again--throw crap at the wall and see what sticks. Courts should see these ploys for what they are--cynical delay tactics.
