Ocasio-Cortez unveils articles of impeachment against Justices Thomas, Alito

WASHINGTON (CN) Congressional Democrats on Wednesday fired their latest salvo in their battle against ethical malfeasance at the Supreme Court, as New York Representative Alexandria Ocasio-Cortez filed articles of impeachment against Justice Clarence Thomas and Justice Samuel Alito. Though the move may prove mostly symbolic in the House, which remains in Republican control, its the most drastic effort yet to hold the justices to account for what Democrats and many legal experts have long said are flagrant violations of the kind of ethical conduct expected of the nations highest court.
Justices Clarence Thomas and Samuel Alitos pattern of refusal to recuse from consequential matters before the court in which they hold widely documented financial and personal entanglements constitutes a grave threat to American rule of law, the integrity of our democracy, and one of the clearest cases for which the tool of impeachment was designed, Ocasio-Cortez wrote in a statement Wednesday.
Both justices have come under scrutiny over the past year or so amid reports that they both failed to disclose gifts and travel paid for by wealthy conservative benefactors including billionaire real estate magnate Harlan Crow and Federalist Society founder Leonard Leo. Thomas and Alito have also resisted calls from lawmakers to recuse themselves from cases involving the 2020 presidential election and the Jan. 6, 2021, Capitol riot.
In articles of impeachment against Thomas, Ocasio-Cortez argued that the justices failure to report gifts and hospitality from Crow undermined the impartiality and integrity of the Supreme Court. His conduct has caused a reasonable person to believe the gifts were offered and accepted in return for being influenced in the performance of an official act and from the same or different sources on a basis so frequent that a reasonable person would believe that he used his public office for his own private gain or for the private gain of his donors, the New York Democrat wrote.

(3,017 posts)the president can do whatever, as long as some lawyer, somewhere, somehow can argue that it was related to his official duties. (Does Clearance Thomas think that taking tips is an official duty)?
But the people that carry out the president's orders may not have immunity. Apparently, although the president does a thing which is an official duty, and cannot be held accountable for it (unless Congress puts the president on trial and convicts them LOLOLOLOLOLOLOLOLOLOLOLOLOLOLOL), the action itself is still illegal and could be stopped by the supreme court or Congress. And people who carried out the act, under orders of the president of course, could be prosecuted, probably. Apparently it is pretty much a case-by-case thing where lower courts take as long as they want, the supreme court either decides or bats it back to stall further.

(11,780 posts)And they are counting on him winning the election. After that who knows, if he starts going batshit crazy they might decide they need a new ruling. When the gave out that ruling on the last day of the term I no longer doubted there is some conspiracy to undermine our govt. if trump was to actually win the coming election (god forbid) Id hope his first executive order would be fire the SC and imprison them on some trumped up charge.

(3,446 posts)It seems to me that it made Thomas's gifts not criminal for sure. However, it is a felony to knowingly make false financial statements. Nothing will happen of course with the DOJ being dependent on the Republican house. We are truly a kleptocracy with the Republican controlled house. The IRS is in the same boat.

(18,108 posts)In a fantasy world, Mr Kavanaugh and Mrs Barrett ought to be impeachable for outright lying at their confirmation hearings, but the two AOC has chosen have the most points of vulnerability.
Now, if the Democrats can only secure the landslide victory they deserve in November, we might could actually do something about it.
I do think Mr Biden ought to appoint a couple of new Justices. However, that is a non-trivial pursuit. The majority in the Senate being what it is, it only takes one or two dissenters who are nominal Democrats to nip that plan in the bud. Of which I'm sure Joe is more than aware.

(4,834 posts)I expect a collective, national dialogue regarding the exploitation of the system by a few of the sitting justices as summer ends and the final heat of the campaign beings. I tend to think Rep. Ocasio-Cortez is simply providing additional insurance it happens.

(164,650 posts)These articles are in effect a political stunt in that there will be no committee vote and these articles will never reach the floor of the House. However, these articles do make a great case against Thomas and Alito. Control of the SCOTUS is on the ballot this year and we need to make sure that TFG cannot replace Thomas and Alito with younger assholes
