DHS Secretary Flouts SCOTUS Order, Says 'No Scenario' Where Abrego Garcia Comes Back

WASHINGTON Homeland Security Secretary Kristi Noem on Thursday openly flouted a Supreme Court order to facilitate the return of Kilmar Abrego Garcia to the U.S., insisting during a Senate committee hearing that there is no scenario in which the Maryland man will be in the country again.
In response, Sen. Chris Murphy (D-Conn.) called her remarks incredibly chilling for the balance of powers in a democracy. Noem was testifying before a Senate appropriations subcommittee when she made her comments about Abrego Garcia, who federal law enforcement officials last month arrested in his home state of Maryland and deported to an El Salvador prison.
The Trump administration has accused Abrego Garcia, who has no criminal record, of being a member of the international gang MS-13, which his family and attorneys have denied. Originally from El Salvador, he was granted a withholding of removal order in 2019, which prevents the U.S. government from sending him back to his country of origin due to a credible fear of persecution. Hed been legally living in Maryland until ICE agents detained and deported him in March, which the administration said was due to an administrative error.
In a 9-0 decision, the Supreme Court last month ordered the Trump administration to immediately facilitate Abrego Garcias return and proceed with its case against him in the U.S., as he was never given due process, which is required by the Constitution. But the administration has been violating the courts order which on Thursday Noem bizarrely said wasnt true, while also insisting Abrego Garcia is never coming back to the U.S.

(50,343 posts)They see *no consequences* to ignoring SCOTUS order, which means they have no worry of being charged with crimes over this, which means they expect presidential pardons if they are charged, which means MAGA Republicans have no intent to relinquish power in their lifetimes.
It's not enough to say 'it's not a violation of law if you save the country'. That's just bravado. This is far more.

(11 posts)deputize basically anyone to become their Marshals (DC metro police for example), and then have them go arrest Noem, Bondi, etc. until the decision by SCOTUS is implemented? The founding fathers were very concerned about a tyrannical executive taking power. Maybe this is how its done?

I'm attempting to figure out in my feeble little mind how the Supreme Court will ever enforce its' decision if tRump controls all the agencies responsible for enforcement. The only answer I come up with is that we're fucked.

Massive pressure, rolling general strikes, and obstinate obstruction on a daily basis until this shit changes. Its the only way I see that we can protect, and then recharge our democracy. This democracy belongs to us, we are responsible for its maintenance, so, as it stands now, if something doesnt change, then nothing will change. It is on us.
