US appeals court blocks New Mexico's 7-day waiting period on gun purchases

Santa Fe, New Mexico AP — A panel of federal appellate judges ruled Tuesday that New Mexico’s seven-day waiting period on gun purchases likely infringes on citizens’ Second Amendment rights, putting the law on hold pending a legal challenge.

The ruling by the 10th US Circuit Court of Appeals sends the case back to a lower court. New Mexico’s waiting period went into effect in May 2024, and does hold an exception for concealed permit holders.

“Cooling-off periods do not fit into any historically grounded exceptions to the right to keep and bear arms, and burden conduct within the Second Amendment’s scope,” wrote Judge Matteson Tymkovich in the split 2-1 ruling. ”We conclude that New Mexico’s Waiting Period Act is likely an unconstitutional burden on the Second Amendment rights of its citizens.

Two New Mexico residents had sued, citing concerns about delayed access to weapons for victims of domestic violence and others. Democratic state lawmakers had enacted the restrictions in hopes of ensuring more time for the completion of federal background checks on gun buyers.

8. Satire aside, if someone threatens your life or your family, sometimes you really do need a gun right away

And the vast majority of the time that can be done because the computerized background check is instant.

Just mail the guns. Ground. From out of state. Certified delivery in person.

3. The USPS has equipment to run packages through X-ray machines

particularly from/to urban hubs and if the package looks "suspicious". This is why the proliferation of "ghost guns" where it's just "parts".

Honestly, unless there's a critical need to have a firearm, people can wait. The zombie invasion isn't on us yet, and Obama ain't going around door to door to take your guns either. We all have to wait for certain things - there is no constitutional rule for instant gratification.

6. But watch what will happen in the future

where THEY will "take away the guns" - at least from certain people they are afraid of. That will be coming (attempting to unilaterally "suspend the 2nd Amendment" due to a "national emergency" ).

Everything they say that they accuse others of doing is nothing but a "projection" of what they are guilty of and/or in this case, what they might end up doing to others (e.g., "weaponizing DOJ", creating "FEMA camps", etc.).
