BALTIMORE — Kilmar Abrego Garcia, who reunited with his family last week after 160 days apart following his mistaken deportation to El Salvador, was taken into ICE custody on Monday after an immigration check-in, his attorney said. The check-in with U.S. Immigration and Customs Enforcement in Baltimore was part of the conditions of his release from federal custody on parole on Friday.

While such meetings are usually routine and are meant for case updates, Abrego's attorneys said they expected he would be taken into ICE custody during the check-in after the Trump administration announced over the weekend its intention to deport him to Uganda.

He said lawyers asked ICE officers why Abrego was taken into custody, and the officer would not answer. The ICE officers would also not give information as to where Abrego is going, Sandoval-Moshenberg said. "There was no need to take him into ICE detention. ... The only reason they took him into detention was to punish him," for using his constitutional right to speak up and fight proceedings, Simon Sandoval-Moshenberg, one of Abrego's attorneys, said Monday morning.

Sandoval-Moshenberg said on Friday that a notice said the 8 a.m. meeting on Monday would be for an interview. "Clearly that was false," he added. He said lawyers asked ICE officers why Abrego was taken into custody, and the officers would not answer. The ICE officers would also not give information as to where Abrego is going, Sandoval-Moshenberg said.

He was deported to an El Salvadoran prison by an administration mistake.
After a month in that prison, a judges ordered his returned to US.
Where he was arrested and charged with trafficking.
He was offered a plea agreement with deportation to Costa Rica.
He refused the deal.
The main witness against him is a three time convicted felon who will not be deported in exchange for his testimony.
Garcia was arrested today when he showed up for his immigration hearing.
The government is now trying to deport him to….Uganda?

He was brought back to the U.S. in June to face charges in Tennessee of allegedly transporting undocumented migrants within the U.S. while he was living in Maryland. He has pleaded not guilty.

In July, U.S. District Judge Paula Xinis ordered that, should he be released while awaiting trial, Abrego Garcia be placed under ICE supervision in Maryland, where he was living with his wife and children before he was mistakenly deported in March, "to "provide the kind of effective relief to which a wrongfully removed alien is entitled upon return."

Xinis also said that if the government intends to deport Abrego Garcia to a third country, it needs to provide 72 hours' notice.

The order allowed the Trump administration to initiate "lawful immigration proceedings" when Abrego Garcia returned to Maryland. The immigration proceedings may or may not include "lawful arrest, detention and eventual removal," Xinis said in July...............

We can't rely on the courts. The process is too slow and they don't comply with the decisions anyway.

Wes Moore is my governor. I know he has "talked tough" against Trump. But what I'd like to see is democratic states shield these individuals so that ICE physically can't get them. MAKE A SCENE. If ICE wants this person, they are going to have to beat/detain local police/first responders. Bring out the Maryland National Guard and fight back against these shadow agents with no ID.

MAGA don't care about the courts. They will appeal/delay/breach any decision that goes against their nazi plan. By the time anything meaningful comes out of a court order, the main argument has been lost.

I know I am dreaming, and this will probably never happen, but this is where we are at. If our political leaders will not fight back outside of the courts, democracy in this country is gone.

But a court filing from Abrego’s lawyers over the weekend shows that the administration has taken its vengeance to a new level. According to the filing, on Thursday — the day before he would be released — the government told his counsel that if he agreed to stay in custody and plead guilty, then he could be deported to Costa Rica after he serves whatever sentence the court would impose. Like El Salvador, Costa Rica is a Spanish-speaking country in Central America.....

After his release, an immigration official said the government now wants to deport him to the African nation of Uganda. He was ordered to report to a Baltimore immigration office on Monday morning and was given until then either to accept the Costa Rica deal “or else that offer will be off the table forever,” Abrego’s lawyers wrote in the Saturday filing......

I should note that in criminal cases across the country — ones you’ve never heard of and never will — prosecutors make plea offers that force defendants to make choices that would put them in bad situations immediately to avoid worse fates down the line. Against that backdrop, it’s unsurprising that most cases don’t go to trial. In the ones that do, defendants who are convicted face greater punishment than they would have faced had they pleaded guilty, a phenomenon that’s been called “the trial penalty.” So at least from the defense’s vantage point, there’s an element of legalized coercion baked into the system.

In that light, it’s understandable that not everyone sees American justice as a righteous concept to begin with. But it can always be further degraded.

The Trump administration seems hellbent on such degradation. Having embarrassed itself with the illegal removal of Abrego and failure to quickly fix it, it’s now acting as a sort of dystopian travel agent in a desperate bid to avoid a criminal case that it didn’t have to bring in the first place.

Rather than ensuring that Abrego “face justice,” as Bondi proclaimed upon his U.S. return, the government appears to be trying to save face. No matter what happens next, that won’t be possible in the eyes of people who’ve been paying attention. The damage to American justice has been done.
