Trump lawyer turned judge immediately hit with misconduct complaint for attending president's 'rally

A former Donald Trump criminal defense attorney turned controversial DOJ higher-up and then lifetime federal appellate judge faces a judicial misconduct complaint just one day after attending the president's rally in Pennsylvania.

Fix the Court, which describes itself as a "nonpartisan" nonprofit advocating "for non-ideological fixes that would make the federal courts, and primarily the U.S. Supreme Court, more open and more accountable to the American people," is headed by executive director Gabe Roth, the individual who made the complaint Wednesday against U.S. Circuit Judge Emil Bove, who sits on the 3rd U.S. Circuit Court of Appeals.

According to the complaint submitted to Chief Judge Michael Chagares, although there is "no prohibition, of course, against a federal judge attending an event at which a President is speaking" — citing, by way of example, Supreme Court justices' typical attendance at the State of the Union address — "it should have been obvious" to Bove that Trump's Mount Pocono, Pa., event was a "rally," consistent with the White House's own description, making it a "highly charged, highly political event that no federal judge should have been within shouting distance of."

"To offer but a few examples, President Trump attacked 'the radical left' about 90 seconds in. Three minutes in, he started talking about the 2020 election, which he falsely claimed he won, and six minutes later, he encouraged rallygoers to boo at the 'fake news,'" the complaint said, adding that Trump "mused about running for a third term," called former President Joe Biden a "son of a b—," and blasted Democrats as "sick people." With "no reports that Judge Bove vacated his seat after hearing any of these injudicious comments," Roth said, it is "fairly clear" that Canon 2 of the Code of Conduct for U.S. Judges was violated.
