Democratic Gov. Says He's 'Considering' Clemency for Pro-Trump Official Convicted of Election Breach

Colorado Governor Jared Polis (D) said that in his last stretch in office he is considering clemency for Tina Peters, the former Mesa County clerk who was jailed over an unauthorized breach of voting systems when seeking to validate President Donald Trump’s claims of fraud in the 2020 election. Peters, 70, was convicted last year on state charges after participating in the 2021 breach and is serving a nine-year sentence in a Pueblo women’s prison.
In an interview with CBS Colorado on Thursday, Polis told journalists he was weighing clemency and described the prison sentence handed to Peters as “harsh” and implied he was reviewing her case alongside others involving elderly inmates.
“She got a sentence that was harsh. It was a nine-year sentence,” Polis said. “We always look at people’s sentences, and when you have people that are elderly, and we’re looking at this across a number of people – people in their 70s and 80s in our system – how much of a threat to society are they? And we balance that in a way that makes sure that they can spend their last few years at home.”
The campaign for Peters’ release has been championed consistently at the highest level by President Donald Trump, who, in December, branded Polis a “SLEAZEBAG” for refusing to free her. Trump argued Peters was an “elderly woman” and “cancer survivor” persecuted by Democrats – her age now a factor that Polis has hitched his considerations to.

Like Trump, Polis had a Uber Rich family, best schools, a ton of money, to buy/develop a business, etc etc
He has overwhelmingly shown that 24/7 since his lame duck period started........
With this move, he is either trying to get chummy with the Repubs/Trump, OR if he runs for another office, get voters from sides..
There will be a lot of heads exploding if he lets that woman off, her crime was much more serious than what the main stream media is reporting.....
Who knows, maybe the Republicans are to the point, like the mafia, of threatening people or their families to force them to do what they want........Polis and his partner, (Married?...Husband?....Wife?......) may have been threatened??????

We see that TSF is rapidly declining, and many on our side believe that a successor will be less of a wrecking ball. It seems like hastening reprisals against the state, when delay might reduce the impact to Colorado citizens, would be malfeasance.
Just an idea. I don't actually have any insight, just my own thoughts on "why would someone do this?"

(41,936 posts)If Tina Peters receives clemency, it means the Governor has not only pardoned her and released her from prison, he has also expunged her record like this thing never happened. Clemency should only be done in extreme cases, for example if she had been railroaded politically and never actually did any of the things she was convicted of.
Is that why Governor Polis considering clemency for Tina Peters? I don't think so.

(5,977 posts)A pardon erases the crime if the person accepts publicly they did the crime. He could simply commute her sentence with out pardoning her. He could also make her serve her sentence at home. I'm not sure if he could leave her on parole which I feel is needed as Ms Peters hasn't acknowledged her guilt and still poses a "risk to the community".

(22,413 posts)Clemency can mean sentence commutation or a pardon. It's a broad term meaning to grant mercy. But neither a pardon nor commutation expunges a criminal record. That takes a judge(s).
CO governor is leaning towards commutation. Showing unwarranted mercy just because she's old. In my mind, that's not fair and another reason why I have serious problems with executive clemency in general, unless the subject's legal and constitutional rights were violated. They were not. If they were, she can appeal, which she is doing.
And Polis is term limited and on the way out. Why does he care? This smells funny.

This was not a one time "controversial" act that could be interpreted legally in different ways. She lines up perfectly with the sort of personal traits of Mike Lindell.

And the way to beat a fucking bully is to be a bigger bully. That is offensive to some with delicate little ears both here on DU and in the world at large, but it is 100% truth. We need to fight back and fight back hard and tough and creatively or we might as well whimper and stop complaining. We cannot "go high" and expect to have our lives any more.

Then Wolz had his "debate" with vance and kept "agreeing" with vance. After that Harris started saying she would "give a seat at the table for them, " meaning the repos, and thereafter the Harris campaign's polling stagnated. For 40 years the Democratic establishment kept bowing to the repos. Now there are some Democratic leaders not bowing to the repos,e.g., Adam Schiff, Eric Swalwell, Mr. Raskin, Governor Hochle and most of all, Gavin Newsom.

(4,197 posts)One of our senators, Michael Bennet, is running for Governor. He has said publicly that he looks forward to appointing someone to fill his senate seat. (He, himself, was initially appointed and then ran as an incumbent.) I think he plans to appoint Polis, and Polis is trying to get on Dump's good side.
Polis, Hickenlooper (former governor, current senator), and Bennet are thick as thieves, and have dominated statewide politics for decades. I'm so over them. I've never supported any of them in their primaries (though, I of course, check their boxes when they're the Dem on the general ballot).
We have had some great, young candidates who have been frozen out by these three.

She could have and may have done damage to our system of choosing our leadership because she insisted she knew who should be the President. By offering clemency, you would confirm she was right to do so.

“Governor Jared Polis has granted clemency to numerous inmates, including 22 individuals in December 2024 and 28 in December 2023, often focusing on those who have shown rehabilitation and remorse for their actions. His clemency actions have included pardons and commutations, allowing some inmates to become eligible for parole earlier than their original sentences.”
I don’t think this lady has shown any remorse at all. If she’s truly in poor health, maybe it would save the citizens money by sending her home. But I’d want to see in writing an admission of guilt and acceptance of responsibility for actions. We know that isn’t going to happen.

(30,205 posts)What harm can a 70 years old do? Tina Peters could have been 95 years old and still been able to interfere with elections in the exact same way she was convicted for. Sure, if you're talking about someone who was 6'4" and incarcerated for beating people to death when they were 40, who's now 70 and decrepit, their threat is possibly negated (although, with guns, death by any age is possible). But white collar crime can just as easily be done by old people as well as young. So seriously, wtaf, Polis?

As far as I am concerned, 9 years was pretty light. They didn't throw on obstruction charges that would have added years to her sentence.
If she dies in prison, so be it. We have plenty of people serving life for three strikes with three non violent drug offenses.

She tried to steal the election in CO by stealing a security badge from another employee,
She gave that badge to an associate of Mike Lindell,
She turned off all the security cameras inside the building housing the voting machines,
She then allowed that assoc. into the room to access the software of one of the machines, which the passcodes were later "leaked" onto social media sites,
She then lied and obstructed investigators,
She was charged by a Republican DA in Mesa County, CO,
The jury consisted of citizens of Mesa Co., which, BTW, is a very red county so it stands to reason that there were Republicans on the jury,
The judge who presided over the trial is a registered Republican,
The jury, again, from Mesa Co., convicted her of 7 Felonies and 3 Misdemeanors,
She was sentenced by the registered Republican judge who was quite contemptuous of her continued defiance during trial and sentencing:
And as an added bonus, every Republican election official agreed with the sentence, that should tell Polis just how bad this security breach was.
Here's my message to Gov. Polis, who's office I've already called and respectfully gave the reasons, which I listed above, why I vehemently oppose any pardon or commutation of her sentence, Do not bow down to Trumpedo, it will only backfire on you.

She'll be eligible for early parole within the next two years anyway.

Our revenge must be in putting out the fire they've started and rebuilding the world into a haven for the progressive values we all know make the world a better place for everyone--not just the morbidly rich or the morbidly cruel.

Let’s remember: She wasn't some confused grandmother. She was an elected official who used her position to compromise our democracy. If we start handing out "get out of jail free" cards to election deniers just because they’ve reached a certain age, we’re telling the next generation of MAGA clerks that the consequences are optional. Keep her in Pueblo. Accountability has no expiration date.

The two Democrats who stand a chance of winning the primary are Michael Bennett and Phil Weiser. I like Weiser a bit better as a potential governor, but either would be better than Polis.
I sure wish we had a firebrand like Crockett or AOC in Colorado, though. Institutionalists abound and to survive the descent into Trump-nazism we may well need to get ugly, by which I mean things like massive civil disobedience in the face of sure violence, and acting financially as a sovereign state to cut off tax withholding monies to the Feds because we simply do not have a federal government at this point that is in any way representing us, yet we are all still being taxed heavily to support dirtbags like these billionaires and nazis like Noem, Miller and Bannon. These people aren't doing any American state, city, town, rural area, family or individual a damned bit of good. This latest outrage in Minneapolis just underscores what we've known all along about these assholes.

After everything Trump did to break our election system, we get ONE single, solitary person accountable for anything, and we want to give that up?
If he thinks 9 years is too harsh, then put it on the calendar for consideration in 2029. If the Republicans do no more election tampering in 2026, and 2028, they commute her sentence after 4 years.

(201 posts)This pattern of "reconsidering", of kowtowing is not "being the good guy", mercy or grace. It is weak and it is wrong and it is a lack of care. Without accountability the same old shit keeps happening. It is a continuation of lawlessness.
Where are our strong leaders? People like this governor need to be pressured to be better than this or be voted out.

(2,790 posts)Old people SHOULD be able to live out their lives in some amount of comfort, with family. I would hate the harsh conditions in prison. My body hurts all the time already..
But then I started thinking about Tina Peters as the mean, dishonest person she is, and I thought, “old woman or not, she could still do a lot of damage if she was free to do so. Trump and his regime would laud her as a hero/martyr, and she would continue her evil ways.
Why would we want a mean old woman released upon this country? We already have enough mean hateful people recking havoc.

(800 posts)Anyone involved in even the slightest manipulation of the election process should be thrown under the jail, much less pardoned or given clemency.
I cant think of anything more sacred in democracy than voting and counting votes.
