Birthers Suggest Impeaching Chief Justice John Roberts

The birther movement is now targeting Chief Justice John Roberts for impeachment if he swears in President Barack Obama for a second term later this month.

Craige McMillan, a columnist for the conservative publication WND.com, wrote a piece last week asking Roberts to not swear Obama in, because, according to McMillan, Obama does not meet the Constitution's definition of a natural born citizen. In the piece, McMillan claims that Obama is not a citizen because his father was a citizen of Kenya and the United Kingdom, and that Obama cannot be "a natural born citizen" because his father was not an American citizen. Obama's mother, Stanley Ann Dunham, was born and raised in Kansas by parents who were born in Kansas.

McMillan wrote:

"Your failure to investigate these citizenship issues surrounding Mr. Obama at the time questions were raised during his first term places you in a terrible position. You are now confronted with a most difficult choice.

Your own oath of office, sworn before God and the American people, requires you to uphold the Constitution. (If not you, then who?) If you now administer the oath of office for the presidency to a man who by his own admission fails to meet the natural born citizen requirement imposed by that Constitution, you have violated your own oath of office and are rightly subject to impeachment by any House of Representatives, at any time, now or in the future."

Bush was smart when he picked John Roberts since he was just over 50 when he not only was point on the Supreme Court but was made Chief Justice. At age 57 today that means Roberts would only be about 61 when the new President comes into office. Regardless of party, Roberts will still be around.

To be honest Roberts could be in that position for another 20-30 years.

one in '93 and one in '07. Although the official prognosis is that he has no serious health issues, IMO another seizure would very likely force an earlier-than-anticipated retirement. Not that I wish him ill or anything...

and likes boats. If I recall correctly he was found on a dock next to the boat one time. If he falls in water during a stroke he is history.

I grew up on the Del. River & used to be a life guard. I know how to swim well. I had a seizure a few weeks ago & will never go into a creek, lake or pool unless their are life guards. I was told no baths, showers only to avoid drowning during a seizure.



Chief Justice John Roberts suffered a seizure at his summer home in Maine on Monday, causing a fall that resulted in minor scrapes.

That's according to U.S. Supreme Court spokeswoman Kathy Arberg, who says the Chief Justice had been running errands and was stepping off his boat onto a dock when he experienced the seizure. From Feb 11 2009.

My mother was born in Australia, came here as a war bride, she remained an Australian right up until her passing. I was born here in the United States of America to one US born parent & a passport carrying Australian. Guess I should call my sister & brother's to tell them they are not legal citizen's either.

Question: if you were a Democrat in the House would you vote for impeachment purely so we could nominate a successor to Roberts?

Any chance we can have Alito or Thomas or Scalia administer the oath of office instead? I'm not sure Roberts would lead my list of justices to replace (though obviously he's in the top tier!)...

It would be tempting, but it would be a really bad precedent to impeach a justice who is not accused of any legal or ethical violations solely because I wanted a Democratic president to appoint his replacement. That would prevent us from ever having a stable judiciary again, because there would be nothing to stop impeachments every time the president's party controlled the House and Senate, which is not how the judicial system was designed to work.

The Inauguration is this month and it takes about two months to get through an impeachment. Besides, since the actual legal inauguration day is on Sunday, the actual official swearing in will take place on that day and the one in public will be "for show" which also makes it such that the Roberts screw up of the words from last time moot. But just wait til the birthers get wind of the "secret" swearing in part, they'll be howling to high heaven about that when they find out.

if carried to their "logical conclusion" with the law (or lack of it). Like another DUer on this thread, I attribute this to the SCOTUS Obamacare decision. That's all.

Maybe now he knows how Democrats feel, with the insane RW attacking us as the enemy - but probably just wishful thinking on my part.

a public speech he was giving a few years ago. Taitz tried to give him a ton of files about her case(s), he refused to accept them. The CJ told her he could not accept them and instructed her to give them to an aide.

Even IF he was born in Kenya, which he was not, his mother was an American citizen, making him a United States citizen born abroad, eligible to become President, just like John McCain, who was born in Panama.

So even IF they could prove he was born in Kenya, which is impossible because he was born in Hawaii, they would STILL be thoroughly fucked.

Had Obama been born in Kenya to an American citizen mother, he would be a citizen but not a natural born citizen and therefore ineligible to the presidency.

Weirdly, these birthers don't seem to be making the usual claim that Obama was born in Kenya. Though that claim is completely wrong in fact, at least it doesn't represent a misunderstanding of what "natural born citizen" is. These particular birthers are claiming that Obama cannot be a natural born citizen in any case simply because his father was not a citizen, which is plainly incorrect.

Who was born in Panama, and the difference between a US citizen born abroad and a naturalized citizen.

The weight of legal and historical authority indicates that the term "natural born" citizen would mean a person who is entitled to U.S. citizenship "by birth" or "at birth", either by being born "in" the United States and under its jurisdiction, even those born to alien parents; by being born abroad to U.S. citizen-parents; or by being born in other situations meeting legal requirements for U.S. citizenship "at birth".

Scalia and Thomas impeached. I think we could find a real reason though. Especially with Scalia and Thomas. These two rw idiots have broken so many judicial rules and Thomas has broken the law on several occasions (felonies).

If nothing else, I hope Obama can appoint at least 2 SCOTUS "justices."
