Appeals court won't rehear Trump's challenge to E. Jean Carroll verdict

Source: abc news

Carroll was awarded $83 million in damages for her defamation claims.

By Aaron Katersky April 29, 2026, 11:41 AM

Court upholds $83M judgment against Trump for defaming E. Jean CarrollPresident Donald Trump last year was ordered to pay $83.3 million in damages to Carroll, a former Elle magazine columnist, for defaming her in 2019 when he denied sexually abusing her in the 1990s.

A federal appeals court in New York on Wednesday rejected President Donald Trump's request to rehear his challenges to the writer E. Jean Carroll's successful defamation claims.

A jury awarded Carroll $83 million in damages in 2024 after she successfully argued that Trump defamed her with comments he made disputing her claim he sexually abused her in a Bergdorf Goodman dressing room in the 1990s.

The jury found that, as a result of the comments, Carroll was harassed and humiliated, subjected to death threats, and feared for her physical safety for years.

How many people lose homes, jobs, and families when they have to pay legal judgments. Why should this obscene and obscenely wealthy man get to just say no? How long will he be allowed to abuse the justice system to avoid paying what he owes?

Pay up or go to jail until you pay up, LOSER.

he continues to break the law over and over with no care or remorse AND the fact that no one brings it up (I hope the Dems will be able to do that after the next elections)

And yea, he should be forced to pay E Jean Carrol or he should go to jail.

In this case, he obtained a bond from an insurance company to do so.

In the other case, where she was awarded $5,000,000, he gave the court the cash, which is parked in a court bank account.

Judge Denny Chin wrote that it was the fourth time the 2nd Circuit had denied a request for all judges to hear an appeal in the case.

He noted that Carroll first publicly asserted in 2019 in a memoir that Trump had sexually abused her in the 1990s in a Bergdorf Goodman store’s dressing room.

Trump then claimed he had never met her, called it a false accusation and said “she’s not my type” in an interview. Carroll sued him for defamation in November 2019.

Trump did not attend a May 2023 trial when a jury found that he had sexually abused Carroll and later defamed her. But he briefly testified at a second trial in January 2024 when a jury awarded Carroll $83 million for defamation.

Chin defended the appeals court’s decision to uphold the large defamation award.

“The record showed that Trump made multiple statements over many years accusing Carroll of lying for political and financial gain, and suggesting that Carroll was too unattractive for Trump to have sexually assaulted her,” he wrote.

“As a result of Trump’s statements, Carroll was harassed and humiliated, subjected to death threats, and feared for her physical safety for years. And Trump showed no remorse, continuing his attacks against Carroll during and after two federal trials, and even proclaiming two days into the Carroll I trial that he would continue to defame her ‘a thousand times,’” Chin said.

(USA Today) "President Donald Trump lost another appeal in his ongoing battle against paying New York writer E. Jean Carroll an $83.3 million defamation judgment after denying he sexually assaulted her."

"A federal appeals court based in New York refused Trump's request to have all of its judges hear his appeal, after a panel of three of its judges heard the case and upheld the $83.3 million judgment in September. That tees up a potential appeal from Trump to the U.S. Supreme Court."

"The move means Trump may now also take his appeal of the $83.3 million judgment to the Supreme Court."

"The White House directed USA TODAY to the president's personal counsel. A spokesperson for Trump's legal team said in a statement that the president will be appealing the decision."

It was a decision by the jury and the appeals court will not evaluate the decision by the jury. Only by legal rulings of the court will an appeals court decide a court appeal.

I honestly don't know what her options are at this point...back to court to fight the fact that he'll refuse to pay?

He has a half-billion dollar "war chest" at his disposal. It's presumably for helping Republicans get elected, although I'm sure he'll pocket most of it.

So unless Ms. Carroll's attorneys can tap into "crowd funding" for a legal offense (and at this point, that's not an impossibility). I don't know how they'll counter "I'M NOT PAYING" and then WIN.
