Mom Says NYPD Pepper-Sprayed Baby
By ADAM KLASFELD

BROOKLYN (CN) - NYPD officers pepper-sprayed three little children, including 2-year- and 5-month old babies, because they thought the kids' mom jumped a subway fare, the family claims in court.

Marilyn Taylor sued New York City, the NYPD and Officers Maripily Clase, Suranjit Dey and Jermaine Hodge in Federal Court, for herself, her three children and their father.

Taylor claims that she and her kids were preparing to board a Manhattan-bound L train on Aug. 9. She was pushing her 2-year-old in a stroller and holding her 4-year-old's hand. The father, Dehaven McClain, carried the 5-month-old close to his chest.

The officers stopped her on suspicion of skipping a fare because they saw her pushing the stroller through a service entrance rather than the turnstile, Taylor says in the complaint.

and they punished innocent children and scared them for life. And for what, the fare couldn't have been much anyway.

..."jumping the gun." Or "shooting and asking questions later." The NYPD "thought"??? "Thought" does not warrant pepper-spraying that family. Even if they HAD jumped the fare, it still doesn't warrant the use of mace. Chalk this one up as more proof of 'Police States of America."

5. Because the lawsuit was filed in a Federal court, Rule 11 mandates that the attorney filing it

verify the factual basis for the suit before filing it.

This story has already been reported on DU in another thread.
http://www.democraticunderground.com/12526893

The Federal courts impose sanctions upon those who fail to comply with Rule 11.

Yet there are those who are already showing skepticism about the reported story. I wonder about the humanity of the cops who needlessly pepper-spray and taze people. I also wonder about the humanity of those, notwithstanding repeated videotapes of police deliverying unnecessary and excessive violence, who express their disbelief in such stories.

Wasn't it just recently when there was a reported story of a 17-year old thug in Georgia who was engaging in armed robbery and shot a mother and then shot her infant in the face. Weren't there those who were suggesting that the mother was somehow involved? The cops found the gun which was traceable to the shooter. They also found that this wasn't the first time that he shot someone. What's wrong with these people?

ON EDIT: I am one of the "suspicious about the Georgia woman's story" people, and am responding to that portion of your post. I have no knowledge of the "pepper spray" incident, but based on the post as written, have a reasonable "HOW AWFUL!" reaction.

Where a cop decides they are judge, jury and executioner.

Can you picture a case going before a judge where he orders that the penalty for getting on a train without paying is for the entire family to receive a public pepper spraying?

These stories aren't vetted by reporters. I know there are police in this country who have done some terrible things but I find it hard to believe that subway cops would spray a mother and her baby for no reason at all. It seems there are few details missing from this story.
