James Holmes To Enter Insanity Plea In Aurora Movie Theater Shooting Trial

DENVER — The man accused in the deadly Colorado theater shootings wants to change his plea to not guilty by reason of insanity, his lawyers said Tuesday.

Attorneys for James Holmes said in a court filing they plan to formally ask for the change of plea at a May 13 hearing.

The insanity plea was widely expected given the compelling evidence against Holmes, who is accused of opening fire July 20 in a crowded theater in the Denver suburb of Aurora. Twelve people were killed and 70 injured.

But his lawyers delayed entering an insanity plea for weeks, saying Colorado's insanity and death penalty laws overlapped in a way that could severely – and unconstitutionally – hamper his defense if he did plead insanity.

He will be speaking at a future NRA convention, I would assume.

at least after they've slaughtered a bunch of random strangers.

Before he did the shooting, he could have been their poster boy for arming every crazy person in the country.

I don't honestly care whether it's prison or a nuthouse. He needs to be kept off the street until he's too old to heft any kind of a gun. Or until we have sane gun laws that keep them away from criminals, children, and psychotics.

The mere fact that he planned it, booby-trapped his apartment and carried out his plans in cold blood pretty much ensures no chance of success in an insanity defense. He could distinguish right and wrong and if I have that interpretation of a legitimate insanity defense wrong, someone please correct me...

Send this guy to a deep, dark hole and be done with him until nature runs its course and saps the life from his worthless body. Give him a trial, a conviction, one last look at the sun and then a lifetime of eternal darkness in solitary confinement with the sounds of his victims and their relatives playing as a constant soundtrack to his world.

He should have simply taken one for the home team and ate a bullet on his own instead of firing them into innocent people.

Let him spend whatever time his doctors feel is necessary for his "well-being," then let him start serving his sentence.

There's no way anyone is ever so insane they don't recognize as they act that shooting up a crowded theater is unacceptable behavior.
