Supreme Court rejects bid to halt same-sex marriages in California

The Supreme Court rejected an emergency request to stop same-sex marriages in California, a lawyer for the gay couples who sued said Sunday.

Theodore J. Boutrous Jr., one of the lawyers who challenged Proposition 8, said that he had just received word from the court Sunday morning that Justice Anthony M. Kennedy denied a request by ProtectMarriage, the sponsors of Proposition 8, to halt the marriages.

Boutrous said that Kennedy, who handles petitions from the Western states, did not comment on the decision.

The U.S. 9th Circuit Court of Appeals issued an order late Friday that allowed gay marriages to resume in California, a step that ProtectMarriage said was premature and in violation of procedural rules.

New gay marriage challenge fails


Supreme Court Justice Anthony M. Kennedy turned down at midday Sunday a request to stop same-sex marriages from occurring in California. Without comment, and without seeking views from the other side, Kennedy rejected a plea that the Ninth Circuit Court did not have the authority to put into effect last Friday a federal judge’s order that allowed such marriages. The plea had been made on Saturday by the sponsors of California’s “Proposition 8? that allowed marriage only between a man and a woman.

but they will think they can word it differently and win. Like I said, they will never win. But these are people who are religiously dedicated to their cause and they will not quit. Trust me, I live in a California county with a large Mormon population and I come in contact with these people on a regular basis. They are pathetic in their zeal. They even think they can "undo" the marriages that are happening as we speak.

Northern wine country, about 100 miles north of San Francisco, home of the largest natural lake and the cleanest air in California. Large amount of Seventh Day Adventists here, too. Neither group is much involved with local politics, though. We are a blue county overall. The SDAs own one of the hospitals here and a large amount of the medical community follow that faith. They run a fine hospital.

the people doing this now are not the Mormon Church - yes the Mormon Church was invoked with the actual campaign, but no, other than filing briefs in support of those defending the law they have zero to do with the case and the petitions. Its Born Agains.

They still have time (25 days from the decision) to ask the Supreme Court to reconsider its decision.
Motions to reconsider are routinely denied, so it is extremely unlikely that anything will change. I expect that they will try it anyway. They have to do everything they can, doncha know?

(I HOPE they make it in time to march with Tom, anyway, because they got a late start and the parade is supposed to be packed today!)

That Christian haters will give up on trying to save the US from God's wrath, and will withdraw in disgust to let God's anger smite the country. Repubs lose five or ten percent of their votes by 2014, negating the effects of gerrymandering, creating an overwhelming Democratic win.

Yes, I think there's an outside chance that could happen. Homophobia does mean that much to many social conservatives. I have read comments on conservative sites that do suggest this.

If the House of Representatives does manage to pass some kind of Comprehensive Immigration Reform, I can all but guarantee the RWNJ's will stay home in disgust come 2014.

Sarah Palin has already said - openly - that is the House passes CIR, she and Mark Levin will start a new political party.

It's imperative the House pass CIR....the effect will be a suppression of the GOP base, costing them the House and likely reducing their numbers in the Senate as well.

Rule 22 of the SCOTUS Rules.

3. An application shall be addressed to the Justice allotted to the Circuit from which the case arises. An application arising from the United States Court of Appeals for the Armed Forces shall be addressed to the Chief Justice. When the Circuit Justice is unavailable for any reason, the application addressed to that Justice will be distributed to the Justice then available who is next junior to the Circuit Justice; the turn of the Chief Justice follows that of the most junior Justice.

Paragraph 4. A Justice denying an application will note the denial thereon. Thereafter, unless action thereon is restricted by law to the Circuit Justice or is untimely under Rule 30.2, the party making an application, except in the case of an application for an extension of time, may renew it to any other Justice, subject to the provisions of this Rule. Except when the denial is without prejudice, a renewed application is not favored. Renewed application is made by a letter to the Clerk, designating the Justice to whom the application is to be directed, and accompanied by 10 copies of the original application and proof of service as required by Rule 29.

I'm not prepared to say that action on the application is "restricted by law" to the Circuit Justice and that the request for relief can't be presented to any of the other Justices. But even it can and is presented to another Justice, its unlikely to be granted.

Those filing for an emergency stay were stupid. The court had just ruled on the matter of standing and the parties asking for the stay lacked standing based on the court's own analysis of that required element to bring a matter to the court.
