Kansas Supreme Court will hear Chad Taylor ballot case on Tuesday

The Kansas Supreme Court said Thursday that it will hear the case of Democrat Chad Taylor, a former Senate candidate who has filed a lawsuit seeking to be removed from the ballot. The outcome of the case could carry substantial implications in the battle for the Senate majority.

In a two-page order, Chief Justice Lawton R. Nuss said the court will hear oral arguments on Tuesday morning. It will not be heard by a district court, as requested by Secretary of State Kris Kobach (R).

At issue is a dispute over whether Taylor's name should be removed from the ballot. If it comes off, it could give Democrats a boost in their effort to hold a fragile Senate majority. If it stays on, it could help Republicans.

Taylor ended his campaign last week on the final day for changes to be made to the ballot. But Kobach ruled that since he did not indicate that he was unable to serve if elected, as required by state law, his name must remain on the ballot, even though he has terminated his campaign.

kobach has a leg upon which to stand; but, the statute is INSANE.

25-306b. Withdrawal from nomination; omission of name from ballot; death of nominee; person filling vacancy may withdraw. (a) Except as provided by this section, no person who has been nominated by any means for any national, state, county or township office may cause such person's name to be withdrawn from nomination after the day of the primary election.

(b) Any person who has been nominated by any means for any national, state, county or township office who declares that they are incapable of fulfilling the duties of office if elected may cause such person's name to be withdrawn from nomination by a request in writing, signed by the person and acknowledged before an officer qualified to take acknowledgments of deeds.
