Turtles band members win copyright dispute against Sirius XM

Sept 23 (Reuters) - A U.S. judge has sided with members of the 1960s band the Turtles in their dispute with Sirius XM Holdings Inc, ruling the satellite radio provider infringed on copyrights by airing their pre-1972 songs without paying royalties.
U.S. District Court Judge Philip Gutierrez ruled in favor of Flo & Eddie on Monday, saying that copyright ownership of a sound recording includes the exclusive right to publicly perform that recording.
Flo & Eddie was created in 1971 and is owned and controlled by Howard Kaylan and Mark Volman, two of the founding members of the Turtles, who were most popular for their 1967 hit single "Happy Together". The lawsuit was filed in August last year, seeking royalties from the satellite broadcaster.
"Flo & Eddie," the judge ruled, "has the right to possess and use its sound recordings and prevent others from possessing and using them."

(1,112 posts)They have been deleting (one of only two instrumental classical) and pre-empting (40s, easy listening) channels and eliminating djs (50s), while adding more and more barely-differentiated dance-pop options, telling the annoyed fans that the missing stations "don't appeal to our desired demographic" and not seeming to care when they cancel. I don't know what demographics have to do with non-ad-supported subscription service, but they'll probably just continue to shrink pre-1972 plays (the cutoff date affected by the Flo & Eddie case). I'm addicted to enough of what's left to renew (unfortunately), but SiriusXM sucks...
Flo & Eddie are great, hysterical live performers, by the way...

It is a good source for me for LIBERAL talk radio I can't get elsewhere. Bill press, the sexy liberal Stephanie, and Thom Hartman.

So I'm done with them. Amazon has tons of CD's with the music that I like (50's and early 60's), so that's the way I'm going.
And like you, I'm puzzled (and angered) by SiriusXM's moves here.

Bill Press offers consistent progressive values in an entertaining form. I first learned of Bill when Sirius-XM carried his show in it's entirety back when I got my first XM radio in 2009.
The current Sirius-XM exclusive show "The Agenda" isn't even close to what Bill's show offers. Listen to your paid subscribers. We want the Bill Press show in it's entirety like the old days on Progress 127 so I can listen in my car on the way to work. That is why we pay for programming in our cars, online, etc. in the first place.
