U.S. uncovers $20M H-1B fraud scheme

Prison time is possible in visa-for-sale case, say feds

The U.S. government has indicted a Virginia couple for running an H-1B visa-for-sale scheme the government said generated about $20 million.

Raju Kosuri and Smriti Jharia of Ashburn, Va., along with four co-conspirators, were indicted last week by a federal grand jury in Alexandria, Va., according to the Department of Justice (DOJ).

The scheme involved, in part, setting up a network of shell companies and the filing of H-1B visas applications for non-existent job vacancies.

Workers were required to pay their own visa processing fees and were treated as hourly contractors, the DOJ alleged. Treating H-1B workers as hourly contractors is in violation of the program rules, the government said.

The corporate HR and hiring managers may plead ignorance, but they should know better - and I guaran effen tee that some of them DO know what is going on.

If the companies weren't hiring these "parasites" they wouldn't be coming. I don't like that word, by the way, BUT --

One point I would like to make - based on my personal experience, which admittedly may not be universally accurate - for any soft-hearted Dem who may think these are just poor immigrants coming to the US for a chance at a decent life - NO. That is probably true for a lot of immigrants who cross the Mexican border. But H1-B visa holders tend to come from the wealthier classes in their home countries (yes mostly India, but not exclusively India). They are not coming to the US for a livable life. They are coming to the US to make vastly more money than they make at home, and send it home to their families. Who can no doubt use the help but who are NOT destitute and struggling (in most cases) relative to others in their homeland. They come here to get richer, not to just survive. So this is a different kind of immigration question. Save your concern for the people who are fleeing genuine hardship. Please.

I think people also don't understand that the visas go to companies, not individuals. Even so-called liberal companies like Google take advantage of this.

If this is the case, what is your response doing in a thread on H1B visa fraud? I see nothing wrong with H1B visa program or Hillary's stance on it. It is the abuse of process that is problematic.

But my objection was not to your opinion. It was to the post that implied Hillary's position will translate to more visa fraud. Guilt by association, and a cheap trick.

and the number of visas increases as she seems to support, then YES, the actual number of fraudulent visas will increase.

I just don't think it's right to put it all on Hillary. It takes many more to make this policy happen. The fact that we are talking about it today is due to many, many enablers in our system.

I doubt Bernie would have made visa fraud his number 1 priority. My experience generally with dem politicians is that they don't know the difference between someone seeking an H1-B visa, and someone fleeing a genuinely terrible situation in their home county. Hence my lengthy statement above. Even if Bernie does get it though, I seriously doubt it would be on the top of his list to solve.

And Trump? Ha. Doesn't matter what he says at all, it is all bullshit, and if you've been paying attention you know it. Trump is for Trump and will do whatever he thinks makes things better for Trump, regardless of any words he's said on any given day. All those bankruptcies he's had? Do you think he shed one tear for all the workers who lost their jobs and had their lives upturned? Trump does not give one single f*ck, flying or otherwise, unless he thinks it helps Trump. Which reducing H1-Bs won't. It's too ingrained in our economic system. Which yes, it is possible Bernie knows, but a) I doubt it would be a priority and b) he would need a whole lot of help in Congress to fix anything.

So we need to vote for the best Dems we have and try to get the ones that don't get it, to finally get it and take action.

(Reality: IT workers as a voting block aren't very powerful. At least not yet. Fix that and you have a chance of fixing H1-Bs.)

Just states the obvious by saying that you are not paying attention - because you don't want to know, or don't want to have to defend her. Her track record with all of the visa programs is a disgraceful slap in the face to the citizens of this country and a windfall to her top corporate campaign contributors.

Rather than deflection with lame questions, make and attempt at performing actual research on the candidate that you blindly support.

If they're going to come over and replace me at my tech job, they should get paid the same I was paid!

A 40 hour week salaried position guaranteed to work you 50 to 60 hours a week without any additional compensation and non existent health insurance that you pay for additionally.

American workers put hours in for free w/o complaining. What the hell does the rest of the world know.

They're trying to push their socialist bullshit and make sure that employees get paid for every hour they work. Fuck That!

H-1B and L1 visa fee has been increased by $4000 and $4500 respectively on Friday (18th December, 2015) by the US Senate. The fee, previously $2000, was waived off in September, 2014 but now it has again been imposed on IT companies.

President Obama said, “It will soon become a law”.

The bill says that IT companies would be liable to pay a staggering amount of $8000 to $10,000 for an H-1B visa. This amount will be applicable for H-1B visa and L1 visa as the next annual visa filing season commences, from April 1st 2016.

The new bill passed by Barack Obama says, “Companies having more than 50 employees and having more than 50% of H-1B visa employees would pay an extra fee of $4000 for H-1B visa and $4500 for L1 application ”.

When you advocate for more visas, you are in effect inviting more scams. When there is money to be made, more people get taken.
