More than eight months after the shooting death of 17-year-old Alvin Cole in February, the Milwaukee County District Attorney's Office announced Wednesday it would not charge Wauwatosa Police Officer Joseph Mensah.
Earlier in the day, a separate report by third-party investigator Steven Biskupic recommended the Wauwatosa Police and Fire Commission fire Mensah.
"In this case, there is sufficient evidence that Officer Mensah had an actual subjective belief that deadly force was necessary and that belief was objectively reasonable," District Attorney John Chisholm wrote of his decision. "I do not believe that the State could disprove self-defense or defense of others in this case and therefore could not meet the burden required to charge Officer Mensah."
After meeting with Chisholm, the Cole family voiced concerns about his ruling. Taleavia Cole, Alvin's sister, said Chisholm showed his bias.
All these Black families walking in here to meet with you about their loved one that has been killed by Joseph Mensah, and you have yet to not justify it," she said. "The fight doesn't end here. We've got to make sure Joseph is fired immediately."

Family of Alvin Cole renew demand for justice after Wauwatosa Police Officer not charged over his death

Milwaukee County District Attorney John Chisholm announced on October 7 that there would be no charges against Wauwatosa Police Officer Joseph Mensah for the fatal shooting of 17-year-old Alvin Cole earlier this year.
Mensah fatally shot Cole outside Mayfair Mall on February 2. During the incident, authorities said that Cole ran from the police and fired first before he was shot. Coles family disputes that he fired the gun.
Coles family met with Chisholm privately before the decision was announced publicly outside the Milwaukee County Safety Building. While no charges were filed, Chisholm did not say the shooting was justified.
Attorney Kimberly Motley, who is representing the Cole family, pointed to the independent investigation, which found Cole did not shoot at Mensah. The report also recommended Mensah be fired. Motley said they will continue to fight and has called for Mensah to be fired.
Before the decision was announced, a large crowd gathered outside the building and chanted Say his name. Alvin Cole and Black Lives Matter. Both Cole and Mensah are Black.
