US States Could Ban People from Traveling for Abortions, Experts Warn

As abortion bans proliferate in states around the US, some state legislatures are likely to go even further than just ending abortion in their jurisdictions taking aim at the growing numbers of people seeking procedures and medications out of state, experts warn. If, as the bombshell leak of its private vote suggests, the supreme court weakens or overturns Roe v Wade the 1973 decision that established a constitutional right to abortion in an upcoming decision on Mississippis 15-week abortion ban, states will be left with a confusing patchwork of laws that will probably lead to legal challenges.
A fresh wave of restrictions will probably center around patients who leave their state to obtain legal abortions in other states, or who order medications to manage their abortions at home. Lawmakers in Missouri weighed legislation early this year that would allow individuals to sue anyone helping a patient cross state lines for an abortion. The law was ultimately blocked in the states legislature, but experts expect such legislation to gain more support if Roe is weakened or overturned.
I think states are not going to rest with just saying there wont be abortions in our state. I think theyre going to want to ban abortion for their citizens as much as they can, which would mean stopping them from traveling, said David Cohen, professor at Drexel Universitys Kline School of Law and lead author of a forthcoming article on cross-state legal issues that could arise in the abortion context. Were going to see state-against-state battles that are really going to divide this country even deeper on this issue, he said.
If the supreme court overturns abortion protections, such travel bans might also be permitted to stand, Cohen said. "The supreme court does not have well-developed case law regarding extraterritorial application of state law, he added in an email. A court that has gone so far as to overturn Roe, he said, would likely take that unclear precedent in the direction that is most anti-abortion. But banning travel would go against basic American principles, he said. You have freedom of travel in this country, and as long as youre following the law in the state where you are, you are legally OK under current law. For instance, adults can gamble in states where its legal, even if theyre from states where its not allowed...

The Mann Act, passed in June 1910 and named after Illinois Congressman James R. Mann, invoked the Commerce Clause to felonize the use of interstate or foreign commerce to transport women for immoral purposes. The Act was aimed at prostitution, immorality, and human trafficking.

(4,664 posts)Next step; Dr.'s must report all pregnancies to the state. If you give birth without the using proper channels, the woman will be sent to prison and risk having her children taken to a "Boarding School".
I know some here think this is BS. I grew up in a cult and listened to them plan every detail. A week ago you didn't believe they were going to overturn RvW.

(53,386 posts)Most of us knew they were going to overturn Roe the second Donald Trump was declared the winner of the 2016 election.
And yes, I thoroughly expect every girl and woman over the age of 13 will be subjected to a pregnancy test before crossing a state line in the red states. You'll need to take one when you leave and another when you return...and if you were pregnant when you left and not when you got back, you got some 'splainin' to do.

(4,664 posts)I was raised in a religious cult. We were required to show proof of periods each month. I showed my father, married women showed their husbands. If you didn't have either, one of the ladies from church took care of it.

We need to hold solid power for the next ten years.

I doubt one party can hold onto the reigns of Congress and the Executive for that long. Americans usually have a propensity for divided government. Republicans have taken advantage of structural advantages like gerrymandering and the Senate (small states given the same power as large states). I don't see that changing unless it becomes disadvantageous to them.
