What you need to know about Idaho abortion laws. Yes, it's a total abortion ban

The Idaho Legislature has enacted some of the strictest abortion laws in the country. The “total abortion ban” went into effect on Aug. 25. It bans all abortions. There are NO exceptions. None. No exception for the life of the mother. No exception for rape or incest. No exception for a pregnancy complicated by a lethal fetal diagnosis.

The total abortion ban does allow a doctor to bring an affirmative defense in court. The affirmative defense can be that the doctor acted to save the life of the mom or that the pregnancy was the result of rape or incest that were reported to the police and the doctor was given a copy of the police report.

Legally, this is extremely different than an exception. An affirmative defense means the doctor faces a felony charge in court and has to provide convincing evidence that will negate criminal liability. In other words, the burden of proof is on the doctor to prove their innocence.

You should also know that there is another law in effect that allows family members to sue a doctor who provides an abortion after a fetal heartbeat is present. This law incentivizes vigilante legal threat for any pregnancy terminated after a heartbeat is present.

Sounds like a lot of Idaho women will be traveling to Washington and Oregon where we don't have these restrictions.

They don't even realize that more accurate investigations have shown that what was thought to be a heartbeat was actually not. If there is no heart, then there is no heartbeat. And if there is no brain, then there is no brainwave.

Oregon counties vote ‘yes’ on secession from state: report

The secessionist movement by conservative Oregon counties seeking to join Idaho continues to gather steam.

"Residents in Morrow County and Wheeler County have voted in favor of a measure related to moving the state line between Oregon and Idaho, joining nine previous eastern Oregon counties to vote in support of 'Greater Idaho," KPTV reported. "The Oregon Secretary of State website shows on Wednesday afternoon that of 800 votes in Wheeler County, 58% were in favor, and of the 3,837 votes in Morrow County, 60% were in favor."

Harney County joined the movement in the 2021 election, joining, "Lake, Grant, Baker, Malheur, Union, Sherman, and Jefferson

According to the group pushing the idea, Citizens for Greater Idaho, there are now 11 counties that have supported the idea at the ballot box: Baker, Grant, Harney, Klamath, Jefferson, Lake, Malheur, Morrow, Sherman, Union, and Wheeler. The group says Wallowa will vote next.

KPTV noted, "like many of the previous votes, the measures approved on Tuesday did not directly address moving the state border."

There are significant procedural steps to allow the proposal to occur.

Traveling to Oregon or Washington for what they can’t get in their own state because of the legislators THEY VOTED for?

They should be turned back at the border. No hospital should be allowed to accept them.
