Nurse Refuses to Draw Victim's Blood - Arrested

Salt Lake City- the patient was a truck driver who was severely burned in a head-on crash with a vehicle that was fleeing from police and crossed into oncoming traffic.

The driver of the fleeing vehicle was killed.

Because the patient was not a suspect and didn't face potential criminal charges, and the officer did not have a warrant, charge nurse Wubbels refused to take blood. She showed Payne the written policy.

Payne threatened to arrest her for interfering with a criminal investigation -- and he did

certainly the fleeing suspect, and quite possibly the police, are at least largely responsible for this person's injuries.

the idea that they can just take evidence (never mind something as invasive as a blood draw) from what may be a victim of (in part) their own recklessness, that's just crazy.

totally abusing their law enforcement powers to protect themselves.

for any expenses & lost wages for her false arrest.

A warrant is needed to draw blood, if there's no probable cause, right?

Cop has been suspended from those duties, but remains an active police officer.

Cop needs to be fired. He is a slave to his emotions and thinks his orders are the law. That's a very dangerous combination.

and gotten one easily, (if the judge agreed).

I believe that this is covered in the Constitution under the protection from "unreasonable search and seizure".

The man did not cause the crash. There was no reason to draw his blood.

Plus the poor guy was burned and in a coma. I hope he is OK

probably cause he could go to a judge with to get a warrant. POS cop should be fired. Knew he was out of bounds but still tried to bully the nurse. I hope the police department is sued to kingdom come. These kinds of incidents make my head explode. I hope that nurse owns that asshole.

Behavior like this on the part of the cop is the logical outcome of decades of increasing police powers including from the supreme court (the latter not in this circumstance but in many other decisions that have expanded police powers).

That cop's ego took over and all he lost all control. The cop is emotionally unqualified to deal with the public. He should be fired ASAP. Hope that nurse gets LOTS of money from the Police Department.
