All they have to do is claim "I smelled something" regardless to if they did or didn't. I don't like the bust even if she is an R. She wasn't swaying or stumbling she just seemed pissed off and frightened.

I guess I really am a bleeding heart liberal. LOL.

True she shouldn't be smoking weed behind the wheel, and that's like being under the influence of a drug while driving, but if NJ had laws like California, Marijuana is not even an issue here. Unless there is a no smoking law, you could be in public smoking a joint and not be arrested. I prefer to smoke at home, where its just me and my cat, who has his own catnip toy to play with.

Smoking pot in the privacy of your own home is fine. Driving impaired is not.

I don't presume this experience is going to make her any more empathetic.

And yeah- The old 'I smell pot' dodge is the secret password for cops. It's not like you can prove they don't smell it, and it's understood that a judge will always take a cop's word over yours, so they will always be able to get a warrant if they have to- That's when they really fuck up your car, for putting them to all that extra trouble.
