2. The DoJ is not part of the judicial branch; it's part of the executive branch.

It's a federal agency like the DoT, the IRS, and many others, all created by acts of Congress, but intended to facilitate the execution by of laws created by the legislative branch. The Supreme Court, under Article III, has the power only to decide cases but not to create or enforce laws.
