(141,926 posts)Doesn't like 'the rule of 5,' previously articulated.
Justice Thurgood Marshall's papers at the Library of Congress show that most justices subscribe to William Brennan's reported comment to his law clerks that "the most important rule in constitutional law is that with five votes you can do anything."
Of course, ADDING members to the Court would be a LEGISLATIVE decision. guess turtle forgot that part.

It isn't" packing" if the Constitution is followed, it is "packing" when Mitch abuses his power.
The real problem for Republicans is her recent rulings.

(8,863 posts)he worked his ass off to pack the court with incompetent anti-abortion, anti healthcare, anti-voting rights neocon zealots, but if it's true Clarence Thomas is not in the best of health and he retires or dies, then Mitch's wet dream court is in jeopardy...Ginni Thomas and her up close and personal January 6 involvement along with her treasonous Mark Meadows email chain, moves her husband's "retirement for health reasons" a real possibility
Mitch knows Judge Jackson is well qualified candidate for the USSC, he knows the optics opposing her is repugnant but he doesn't care...
