Special Counsel Jack Smith is proving himself to be a different kind of federal prosecutor. Ordinarily, prosecutors wait for a witness to invoke privileges in the grand jury before going to the judge to litigate the legitimacy of those privileges. But Smith is NOT following the usual prosecutorial blueprint. Just two weeks after serving Pence with a grand jury subpoena, Smith has filed a motion with Chief Judge Beryl Howell asking her to preemptively declare that Mike Pence has no legitimate privilege to invoke and ordering him to testify.

Let's hope! And let's then hope that Merrick Garland sees fit to indict. I have a lot more faith in Jack Smith than I do in Merrick Garland, sadly.

but I like his pace and focus so far. But 2024 is looming, and that concerns me regarding Merrick Garland, who seems to be fearful of appearing partisan. The whole "the election is too close" business, which is farcical and capricious, might be just the excuse he needs to not act.

For TFG to be held responsible for his crimes. Garland is responsible for all the divisions within DOJ, while Jack Smith has only one job, investigating TFG.
