Would it be illegal?

Does either care about what we think of his ethics?

I submit that the answer to both is "no"... and therefore the answer to your question is "yes"

If what he said was true then why this: https://www.latimes.com/politics/story/2023-04-06/the-times-reported-about-justice-thomas-gifts-20-years-ago-after-he-just-stopped-disclosing-them
That story is the L.A. Times story about thomas accepting gifts so thomas stopped reporting the gifts, so he knew they were illegal, also does anyone know if the IRS was paid?

Note that Congress just changed the reporting rules.

Either way, there would be no tax implication for him.
