Got a Health Coverage tax 1040 question from when the Health Insurance Mandate was still in effect...
I'm doing taxes from a couple years ago (finally -- don't ask). Had a grandchild living with us who was over 20, taking classes at a local college, and job-hunting. During this period he only managed to work a couple short-term jobs. I'm planning to claim him as a dependent since putting a roof over his head and food on the table was way more than 50% of his upkeep. I work and have employer-based health insurance for me and my spouse; grandson was never on my plan. So he was not meeting the health insurance mandate at that time.
Now, in order for me to claim him as a dependent, I need to be able to say everyone in my "tax household" had qualified coverage or an exemption for all 12 months of the year. Since he had neither, I can't check that box -- but I COULD attach form 8695 and make a "responsibility share payment," which is like $1800. But that payment is technically HIS responsibility, not mine. But as far as I know, he did not file taxes that year, because he wasn't working. (I know, I know, he's *supposed* to have filed, but I know he didn't.)
So what are my options here? I feel I should be able to claim him due to the financial support I provided, but I do *not* feel I should be on the hook for his ACA penalty.

(20,185 posts)The penalty for no health insurance went away in tax year 2019.
If it's for 2018 and before, sorry. If you claim him as a dependent, then you had the medical insurance responsibility too.

(12,809 posts)I didn't think (at the time) that I could add him on my insurance since he wasn't my kid, so I didn't. Could I or should I have? In essence, he was the proverbial "grown man living in his grandparents' basement."
