He came of age in Queens, built Trump Tower, starred in The Apprentice, bankrupted his businesses six times, and drew cheering crowds and angry protesters to Fifth Avenue after his election. Through it all, President Trump rich, bombastic and to many Americans the epitome of a New Yorker was intertwined with the city he called his lifelong home. No longer.
In late September, Mr. Trump changed his primary residence from Manhattan to Palm Beach, Fla., according to documents filed with the Palm Beach County Circuit Court. Melania Trump, the first lady, also changed her residence to Palm Beach in an identical document.
Can Trump avoid taxes by leaving New York? Its not so simple. Each of the Trumps filed a declaration of domicile saying that the Mar-a-Lago Club, Mr. Trumps resort in Palm Beach, will be their permanent residence. The president confirmed the decision on Twitter after The New York Times reported on the move, saying that he would be making Palm Beach, Florida, our Permanent Residence.

Changing his primary residence could carry significant tax implications for Mr. Trump, although how much is unclear without seeing his returns. But in changing his residence to Florida, he would most likely be avoiding New York States top tax rate of nearly 9 percent and New York Citys top rate of nearly 4 percent. Leaving New York could also save money for Mr. Trumps heirs at the time of his death. New York imposes a top estate tax rate of 16 percent for estates larger than $10.1 million.
In an article in the Florida Bar Journal in January 2019, three lawyers with Proskauer Rose wrote about the recent wave of people moving from New York to Florida in large part because of the repeal of the state and local tax deduction that was a byproduct of the tax bill that Mr. Trump signed into law in 2017.
While it may be easy enough for an individual to buy a home in Florida and move, the act of physically moving to Florida is only part of the battle, the three wrote.
The real challenge is proving by clear and convincing evidence that the individual is no longer a New York domiciliary and does not qualify as a New York statutory resident for New York State income tax purposes, they said.
Of course what has now happened is that he did this back last October. And now a year later, Florida has the 3rd highest total number of COVID-19 positive cases, and I also just saw that Texas has supposedly now surpassed California for the COVID-19 death toll.

(34,135 posts)He made a deal with Palm Beach County when he set it up as a club that it could not be used as a residence, not for Trump or for any of the club members. They are restricted to something like less that two weeks a year and that not very many nights in a row.
As a business, Mar-A-Lago gets favorable tax rates rather than the single family residential rate Trump was paying before he made this deal. Since he used Mar-A-Lago as his residence address on his voter registration, that should be held to be invalid and his votes on that registration should be considered fraudulent.
Unfortunately, the Supervisor of Elections of Palm Beach County is not willing to push this point. I believe there are lawsuits by some of the local residents over the whole thing, since they are part of the reason the restrictions were put into the deal with the county that Trump signed.

But I have a feeling that since he has gone down there during winters, that there is probably some long-ago-converted-into-a-house building there on the property but not connected to the resort itself. I.e., what seems to be described here -

Already, when Trump won a victory in 3 statess primaries Tuesday, he delivered his speech from Mar-a-Lago. Like George Bushs Kennebunkport compound and George W. Bushs Crawford, Texas retreat, Trumps Mar-a-Lago is a luxurious escape for his family.
But unlike George Bush Sr. and George W. Bushs homes, Mar-a-Lago is also a business: a private club and spa that reportedly made him $15.6 million last year. Trump keeps a section of Mar-a-Lago private, for the use of his family.

Digging into the catacombs of local records to build an argument against the dock, a small group of loosely aligned preservationists, disgruntled neighbors and attorneys have unearthed documents that they assert call into question the legality of Trumps much-publicized decision late last year to change his official domicile from Manhattan to Mar-a-Lago and to register to vote in Florida using the clubs address. According to those documents, and additional materials obtained by The Washington Post, Trump agreed in writing years ago to change the use of the Mar-a-Lago property from a single-family residence to a private club owned by a corporation he controls.
Its one or the other its a club or its your home, Reginald Stambaugh, an attorney who represents a neighbor opposed to Trumps dock plan, said in a recent interview. You cant have it both ways.
If Stambaugh and his client have their way and persuade Palm Beach to stand firm on its long-standing agreement, Trump will be forced to make a choice, he said: Stop operating Mar-a-Lago as a club and make it a single-family home again or change his official domicile to someplace else.

The guest suites as set forth in the Plan shall be limited to the use of Club members, shall be limited to ten (10) in number, shall not be open to the public, and shall not be advertised. No kitchen or other food preparation facilities shall be allowed in any of the guest suites. The use of guest suites shall be limited to a maximum of three (3) non-consecutive seven (7) day periods by any one member during the year. The operations of the Club shall not result in a nuisance to any of the neighboring properties.
The Land, as described herein, shall be considered as one ( 1) parcel and no portion thereof may be sold, transferred, devised or assigned except in its entirety, either voluntarily or involuntarily, by operation of law or otherwise. This provision shall not preclude the dedication of right-of-way for road improvements required by governmental authority. No portion of the Land or structures thereon shall be condominiumized or changed to a cooperative form of ownership. This provision shall survive the use of the property as a club and shall apply to any subsequent use of the property.
If the Club use is unintentionally abandoned for a period of one (1) year after the Club has been in operation, or is intentionally abandoned at any time, the use of the Land shall revert to a single family residence and the ownership of the Owner. Bylaws and or documents relating to the Club membership shall include an agreement to be executed by Club members acknowledging their understanding of and consent to the terms of this agreement, and specifically agreeing to the reversion of the Land to Owner, and its return of the Land to use as a single family residence, in the event of intentional or unintentional abandonment of the Club use. Owner, Club, and Club members shall agree to hold the Town harmless from any liability or claim against the Town resulting from the enforcement of the terms of this Agreement, the reversion to single family use, the reversion to Owner or any other claims resulting therefrom.
There is nothing in this agreement that sets aside any portion of the Mar-A-Lago property for a single family residence for the Trump family or any exception for continuous residency by the Trump family other than as for the other club members.
In other words, Trump is in violation of this agreement. I suspect the reason the city has done nothing to enforce the agreement is that Trump is not actually in residence and that they do not want to start a fight with the president. On the other hand, a good number of local, legal residents are willing to start a fight and have already begun their battle against Trump.

(37,449 posts)My yard look like wild kingdom a couple of yrs ago , fox, coyote, wandering around, then the turkey vultures showed up in en mass. Turns out they were here for the dead deer smorgasbord. I went out to find out what was so attractive to the fox and coyote. The vultures swooped down off the garage roof towards me. So if you ain't dead yet they will wait, maybe try to take a few pecks and nibbles.

True story but I never saw any kind of vultures around here until maybe 20 years ago. I credit it to improving the urban/suburban environment (and them apparently realizing there was lots of roadkill around). As a kid, we always thought that "vultures" were only flying over deserts out west like in Arizona.
My first intro was when I saw a whole pile of turkey vultures during a work-related trip to North Jersey. They were roosting on buildings in the office park (including perching on the buildings' concrete balconies) and were congregating (and pooping) on the sidewalks. Those were some huge ugly muthas. A few were almost 3ft tall.
Now there are who knows how many circling with the Red-tailed hawks and Cooper's hawks around here.

I like the Turkey Vultures we have here in northern Wisconsin. Although I wouldn't care to share a meal with them, they're kinda cool.
For years, I'd seen large birds floating on the thermals high overhead, and thought they were Hawks. But binoculars showed the red head, and black-tipped yellow beak... awesome!
When I'd sit very still on the deck for a long time reading or birding, they'd slowly drift lower and lower but would gain altitude again as soon as I got up and walked around a bit. Heck, I truly do believe they'd land on Pence.
