He was supposed to go to a state mental hospital, but instead languished in county jail for 10 months
Back in October, after being convicted of animal cruelty for the gruesome decapitation of his mothers cat that he believed wanted to steal his soul, Christopher Frezier was found legally insane, and was supposed to go to Patton State Hospital for confinement and mental health treatment.
He never made it.
Instead Frezier languished for 10 months in San Diego County jail until this week, walking out only after the 4th District Court of Appeal ordered his release. The appeals court on Friday upheld a Superior Court judges ruling that Frezier had been held in custody longer than the maximum three years that his sentence called for, when including custody credits for good behavior.
Freziers plea of not guilty by reason of insanity a type of plea where someone can admit committing the crime but also acknowledge their mental illness makes them not legally responsible should have sent him to a state hospital for care and treatment.
Instead, he ended up spending six weeks longer in jail than he should have. No one seems to know how Frezier got overlooked for so long.
