ACLU lawsuit claims Leon County bail system unconstitutional

The bail system for poor criminal defendants in Leon County is unlawful and unconstitutional, according to a federal lawsuit filed by the American Civil Liberties Union earlier this month.

The class-action lawsuit filed in the U.S. District Court for the Northern District of Florida against the state of Florida stems from the detainment of Brittany Knight since June 17, 2016, on charges of aggravated manslaughter of a child.

After entering a plea of no contest, Knight was sentenced to nine years in state prison and five years of probation on Oct. 18. On Wednesday, she filed to dismiss two claims of excessive bail.

But five days earlier, on Oct. 13, the ACLU claimed that the inability to pay bail in cases like hers was burdensome.
