Uptown New Orleans restaurant ordered to pay $238,300 in overtime wages to employees

Superior Seafood and Oyster Bar, a popular St. Charles Avenue restaurant, has been ordered to pay $238,300 in back wages and damages to 222 employees, the U.S. Department of Labor said.

An investigation by the agency’s Wage and Hour Division revealed that the restaurant failed to properly pay overtime to employees who worked more than 40 hours per week, which is a violation of the Fair Labor Standards Act.

According to the announcement, the management of Superior Seafood "failed to combine the hours worked each week by employees who worked in more than one position." This allowed the restaurant to pay regular hourly wages instead of time-and-a-half for overtime hours, the Department of Labor said.

The restaurant also shortchanged employees by failing to add incentive bonuses into their regular pay before calculating overtime pay, the agency said.

if they had stolen that amount from the Owner?

Someone needs some time as a Guest of the Governor.
