Attorney Discipline Board dismisses two counts against lawyer Matt DePerno (R)
The Michigan Attorney Discipline Board dismissed two counts filed against attorney Matt DePerno related to lawsuits and legal arguments he made in the course of his representation of Republican former state Rep. Todd Courser.
The Kalamazoo County panel found there was not sufficient evidence that a lawsuit brought by DePerno on behalf of Courser was frivolous, nor was there evidence that a motion to disqualify the judge presiding over the case was done for an improper purpose.
But the board declined to dismiss one count that alleged DePerno, a former Republican candidate for attorney general, lacked a good faith basis to file suit against Washtenaw County Judge Timothy Connors. DePerno is scheduled to defend against that count at an in-person misconduct hearing Monday.
DePerno did not immediately respond to a request for comment. But the attorney and former attorney general candidate told the panel in a virtual hearing Monday that adverse rulings and disagreements over legal arguments are not proof of misconduct.
