"Judge seeks more info on traffic video"

ALBUQUERQUE, N.M. — The federal judge who called Albuquerque officials “at least grossly negligent” about one piece of lost evidence in a civil lawsuit against the city and a former police sergeant is asking for more information on another key piece of lost evidence: video footage from traffic cameras at the relevant intersections.

Attorneys for the family of Ashley Browder, killed in a 2013 traffic accident by then-Albuquerque Police Sgt. Adam Casaus, asked for the city to be punished for losing Casaus’ work cellphone (that may have shown he was texting while driving)
and for intentional spoliation of evidence for the lost video footage from two different city locations.

The judge noted there’s a factual dispute about the color of the light when Casaus entered the intersection.

“Despite the fact several officials from the APD and Bernalillo County Sheriff’s Office apparently saw the footage and APD Chief (Ray) Schultz directed that the footage be preserved, the footage was ‘lost’ before plaintiffs were allowed access to it,” Brack’s opinion says.
