Ohio Right To Life to press lame-duck lawmakers to ban abortion after 20 weeks
COLUMBUS, Ohio Ohio Right to Life intends to push legislators this fall to change Ohio law to make abortion illegal at 20 weeks from conception
The push, which would take place after the Nov. 8 election, is an effort to set a new standard one that that could ultimately be used to take on Roe v. Wade, the landmark Supreme Court decision that established abortion as a constitutional right.
Roe and subsequent cases have established viability of a fetus -- the chances of it surviving outside the womb -- as a key factor in determining whether a restriction on abortion choice is constitutional. The general view is that a fetus doesn't become viable until about 24 weeks of development.
Abortion clinics can be regulated so long as the regulations don't create an undue burden on the woman's right to choose.
