Fraternity again accuses Penn State of using hazing death as means to acquire property

WILLIAMSPORT – Penn State again has been accused of taking advantage of a student’s hazing death to trigger deed provisions so it could acquire one of three remaining on-campus fraternities.

The Alpha Upsilon Chapter of the Fraternity of Beta Theta Pi Inc. Monday repeated the allegation it made in June when it sued Penn State and three administrators to try to block the university from reacquiring the chapter house.

The latest filing in U.S. Middle District Court is in response to Penn State’s motion to dismiss the suit.

The fraternity in both its complaint and response accuses the university of using the 2017 death of Timothy Piazza to reacquire the North Burrows Road property without due process and at a below market price.
