Pittsburgh area school: restraining order filed to reinstate masking

North Allegheny parents, students file restraining order against school district to reinstate mask mandate

Less than 24 hours before North Allegheny School District’s first day of school, a group of parents and students has filed a temporary restraining order to get the district’s mandatory mask mandate back in place.

On Sunday around 7 p.m., 11 students and 11 parents filed a complaint seeking to reverse the current optional masking policy, and around 10:30 p.m., they filed a motion for the restraining order, Post-Gazette news partner KDKA-TV reported.

“My clients want to protect their kids. I’m a parent here in the school district; I want to protect my kids,” Alexander Saksen, an attorney for the group, told KDKA.

The group filed the complaint against the North Allegheny School District, the school board, and the individual board members seeking to reverse the optional masking policy.

On Wednesday, the school board overturned the superintendent’s order two days earlier that required mandatory masking in its schools.

The injunction complaint said, “The board’s decision violates Constitutional substantive and procedural due process and will result in irreparable harm to the Plaintiffs, NASD staff, students, and visitors, and the local community at large.”

professionals (doctors, lawyers, etc.) and pro athletes (Steelers, Penguins). It will be interesting to follow......

I grew up there, and graduated from North Allegheny. It was a heavily R area back then, and probably even more so now. Remember, this is the Congressional District that brought you Rick Santorum. (Although Conor Lamb it their Rep now.) I'm totally not surprised that the mask mandate is being challenged.

On August 19th, at an emergency school board meeting enough people challenged the ruling and the board voted 6-3 to make masking "optional."

So last night August 22nd, the group of 11 parents and students filed for a federal restraining order to force the district to follow the Covid-19 masking requirements. Presumably NA teachers are also in agreement.

So the U.S. District Court judge overrules the local school board and upholds the masking mandate. I guess that's the main story.

We're seeing school districts in areas that have already started have high rates of transmission among unmasked students.
