Rutherford Co. judge, who illegally jailed Black children using fake law, faces renewed criticism

A Rutherford County judge illegally jailed children even when there was no crime committed.

According to a report from WPLN and Propublica, Judge Donna Scott Davenport instituted a policy that all children charged with crimes be processed at the detention center. In 2016, 11 Black elementary school children were detained and or locked up after allegedly witnessing a fight between 5 and 6-year-old.

Davenport, the sole Rutherford County Juvenile judge, is facing renewed scrutiny over a “filter system” which allowed jail staff to determine when a child is released.

“There has to be something done to everyone who was involved in this,” said Rep. Gloria Johnson (D-Knoxville). “It’s my understanding that they created a law that wasn’t even on the books in order to make that happen.”

The alleged crime was “criminal responsibility for conduct of another” — a fake law.

“That is horrible abuse of power,” Johnson said. “We have the Administrative Office of the Courts, I believe they should take action and investigate.”

like, as you say, child abuse. (Although, according to her example, locking someone up doesn't require that an actual crime has been committed.)

They should be divested if all profits, capital and face financial penalties. As well as prison and a lengthy postcustody supervisory period.

She needs to lose all benefits received from service in government.
She needs to lose all financial advantages received from this. Meaning anything derived from the illegal action needs to be confiscated. Both property and finances.

She had no legal right to be jailing those kids. She needs to be arrested after she is fired.

The lives she has either ruined or damaged can probably never be tallied.

The Feds need to go in and clean house due to this evil trampling or civil rights.

It seems to me that she facilitated an illegal and coercive separation of children from their families.

If any of those children were otherwise physically/ sexually/emotionally abused while detained under her direction, ougt

Anyway,

If any of those children were otherwise physically/ sexually/emotionally abused while detained under her direction, ought she not be held culpable for those further crimes?

a law or it isn't. If it isn't, then she should be charged with false arrest, kidnapping, and false imprisonment.

Donna Davenport is American Justice writ small.

She is what the American system produces— just as McRapey and Alito and Gorsuch are. Just as what Abbott and Desantis and that fool in Missouri and the one in South Dakota are. The system is weak and in so many cases — too many cases — produces human scum and gives them power and authority over life, death, and even children.

There is much to be cleaned up in our governments, much poison to be removed.
