Peanut plaintiff sues Texas Roadhouse for $1M

HARLINGEN — A million dollars isn’t peanuts. Or maybe it is.

A Harlingen woman is seeking $1 million after she claims she slipped and fell on peanut shells on the floor of a local restaurant.

Amelia Tijerina has filed a civil lawsuit arguing that Texas Roadhouse Inc. is responsible for the peanut shells on the restaurant’s floor.

Texas Roadhouse has denied Tijerina’s allegations and demands proof.

[font color=green]Throwing peanut shells on the floor is just about a half-step up from throwing cigarette butts or spitting your chew on the floor. It's a disgusting habit and a lawsuit might be what is needed to eliminate the unsanitary activity. I've only been to a Texas Roadhouse once and I nearly slipped on the peanut shells also. The place was so filthy that I doubt that I'll ever eat there again.[/font]

I don't even recall any of the bars having peanuts to consume with beer. Most of the bars and restaurants in that part of the state have more of a Mexican theme and less of a country-western atmosphere. The first time I ever went to a roadhouse I had to ask about the custom myself (and I was about 35 years old then).

The lawsuit was also filed in Cameron County which has some of the most plaintiff-friendly juries in the state. Those juries also have a tradition of awarding large judgments. I asked a claim adjuster about this once and he indicated that the juries in that part of the state view cases as local interests vs. monied interests so awarding a large judgment against insurance companies is akin to winning the lottery. If the plaintiff wins, then many juries believe that the settlement money trickles through the rest of the community.

The people that eat there also think that Sirloin Stockade is a "fine-dining" establishment.

were a good starter. We had a bucket to put our empty shells in. The last TR we ate in was clean.
