Ken Paxton lawyers push to dismiss criminal charges
Defense lawyers launched a broad attack on the criminal charges against Ken Paxton late Monday, arguing that misconduct by prosecutors and a previous judge subverted the grand jury process and required the indictments against Paxton to be thrown out.
Prosecutor Brian Wice dismissed the allegations, contained in almost 190 pages of court filings, saying they were so clearly baseless that they did not merit a comment.
But defense lawyer Philip Hilder said the intent was to bring to the courts attention serious matters related to this prosecution.
One defense motion lashed out at prosecutors Wice and Kent Schaffer, saying they improperly disclosed secret grand jury information to news reporters before Aug. 3, when the indictments were made public and Paxton was arrested, booked into Collin County Jail and quickly released on a signature bond on two counts of securities fraud and for failing to register with the State Securities Board.
