Ken Paxton joins Supreme Court challenge to the Affordable Care Act

Texas Attorney General Ken Paxton joined a legal challenge to the federal health insurance overhaul commonly known as Obamacare by filing a brief Wednesday with the U.S. Supreme Court on behalf of Texas and nine other states.

Paxton asserts that the Affordable Care Act, which has been deemed to be a legitimate tax statute by the high court, should have originated in the U.S. House. And since it wasn’t introduced by a House member, as called for by the Origination Clause of the U.S. Constitution, the law should be taken off the books, he said.

Obamacare is an unconstitutional tax on the American people, Paxton asserts.

Paxton’s argument has previously been dismissed by lower courts.

Written in the House was never enacted. The House chose to Amened a version of the Senate Bill and took it through reconciliation.

Technically, the bill originated in the Senate.
