Judge hears arguments challenging indictments against Attorney General Ken Paxton

There were no surprises in the arguments laid out Tuesday during a motions hearing in the criminal case involving Attorney General Ken Paxton.

It’s now up to District Judge George Gallagher to decide whether any of the legal arguments produced by defense counsel are enough to throw out the three felony indictments against him.

On Monday, the special prosecutors in the case filed a motion to amend the indictments to satisfy the concerns about the wording raised by Paxton’s defense team. While the defense argued that it was an 11th hour filing that showed weaknesses in the government’s case, special prosecutors argued the law allows changes so long as there are no new offenses introduced.

The defense is expected to file a written response within 10 days to the proposed changes to the indictments. Gallagher has said he will wait for that filing before he makes any rulings on the numerous motions pending before the court.
