Judge favors Progreso ISD in residency case against state

AUSTIN — A decision letter in favor of the Progreso school district was issued Tuesday afternoon in the 2015 case where the state withheld more than $2 million from the school district, claiming hundreds of children were residing in Mexico and not the United States.

Travis County District Judge Gisela Triana issued the letter in which she stated the Texas Education Agency didn’t follow the proper procedure before making a decision on the residency status of the students and asks for the agency to conduct the investigation again, this time following procedures.

“Defendants failed to properly conduct an on-site special accreditation investigation regarding the residency status of Progreso ISD students,” the letter states. “Although defendants had a valid reason to audit attendance, defendants failed to examine whether the children at issue were allowed under Section 25.001(b) to attend Progreso ISD.”

The school district filed the lawsuit against TEA after an attendance audit for the years 2011-12 and 2012-13, stated hundreds of children who resided in Mexico were reported as residents of the district by Progreso ISD.
